Conditions or Reasons for Planning Application - CB/17/02230/OUT
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt and is located in countryside outside of and not within the village of Chalton. The proposal is inappropriate development within the Green Belt amounting to sporadic development in a rural location which is outside the built-up part of the village of Chalton and would be harmful by reason of inappropriateness, loss of openness and detrimental visual impact and would conflict with the purposes of including land within the Green Belt by way of encroachment of the countryside. Very special circumstances that would outweigh the identified harm have not been established in this case. The proposal is therefore contrary to Section 9 of the National Planning Policy Framework and Policy GB3 of the South Bedfordshire Local Plan Review.
2) The application site is located close to the M1 and other new highway infrastructure. The applicant has failed to demonstrate that suitable levels of amenity in respect of noise levels and air quality can be achieved for occupiers of the proposed development at the site. The proposed development is therefore contrary to policy BE8 of the South Bedfordshire Local Plan Review.
3) The site lies within an archaeological notification area and has potential and could produce remains dating from the later prehistoric through to the medieval period. The applicant has failed to demonstrate through the submission of results of Archaeological evaluation, through both geophysical survey and train trench evaluation, that the proposed development would not have a harmful impact to the significance of the heritage asset and the development is therefore contrary to Policy BE8 of the South Bedfordshire Local Plan Review and the advice in Section 11 of the National Planning Policy Framework.
4) In the absence of a completed legal agreement securing the provision of 30% affordable housing and financial contributions towards education and leisure facilities and services, the development would have an unmitigated and unacceptable impact on existing local infrastructure and would fail to make an acceptable contribution towards the local affordable housing stock. The development would be contrary to the Council's Affordable Housing Guidance Note for Central Bedfordshire (South Area) Adopted April 2016 and paragraphs 50, 72 and 73 of the NPPF.
