Conditions or Reasons for Planning Application - CB/17/02649/VOC
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved, including rainwater goods, have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality, in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
2) No development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved, including rainwater goods, have been submitted to and approved in writing by the Local Planning Authority. 3) No work on the construction of the new buildings shall commence until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season. The development shall thereafter be carried out in accordance with the approved details.

Reason: To protect the character and appearance of the area and ensure appropriate landscaping of the site is implemented in a timely manner in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
4) No dwelling hereby permitted shall be first occupied until a scheme indicating the positions, design, materials and type of boundary treatment shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected has been submitted to and approved in writing by the Local Planning Authority. The boundary treatment shall be completed in accordance with the approved scheme before the buildings are occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) No development shall take place until details of the existing and final ground and slab levels of the buildings hereby approved have been submitted to and approved in writing by the Local Planning Authority. Such details shall include sections through both the site and the adjoining properties, the location of which shall first be agreed in writing with the Local Planning Authority. Thereafter the site shall be developed in full accordance with the approved details.

Reason: Details are required prior to commencement of development to protect the character and appearance of the area and the setting of the listed building in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
6) No dwelling hereby approved shall be first occupied until all on site vehicular areas including turning areas, on plot parking and visitor car parking areas are constructed and surfaced in a stable and durable manner in full accordance with drawing number: 10A and arrangements have been made for drainage of surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
Reason: In the interests of highway safety in accordance with Policy DM3 of the Core Strategy and Development Management Policies Document.
7) No equipment, machinery or materials shall be brought on to the site for the purposes of development until details of substantial protective fencing for the protection of any retained trees, has been submitted to and approved in writing by the Local Planning Authority and the fencing has been erected in the positions shown on the approved drawing. The fencing shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made.

Reason: In the interest of tree protection and to protect the character and appearance of the area and the setting of the listed building in accordance with Policy DM3 of the Core Strategy and Development Management Policies Document.
8) No development shall take place until a Construction Environment Management Plan has been submitted and approved by the Local Planning Authority. The scheme shall identify appropriate measures for the safeguarding of protected species and their habitats and shall include:-
an appropriate scale plan showing protected zones where (any) or (specified) construction activities are restricted and where protective measures will be installed or implemented;
details of protective measures (both physical measures and sensitive working practices) to avoid adverse impacts during construction;
a timetable to show phasing of construction activities to avoid periods of the year when sensitive wildlife could be harmed (such as the bird nesting season);
a person responsible for:
compliance with legal consents relating to nature conservation;
compliance with planning conditions relating to nature conservation;
installation of physical protection measures during construction;
implementation of sensitive working practices during construction;
regular inspection and maintenance of physical protection measures and monitoring of working practices during construction; and
provision of training and information about the importance of 'Wildlife Protection Zones' to all construction personnel on site.
All construction activities including protective fencing and warning signs shall be implemented and maintained in accordance with the approved details and timing of the plan unless otherwise agreed in writing by the Local Planning Authority.

Reason: Details are required prior to the commencement of development to protect features of recognised nature conservation importance (Section 11, NPPF).
9) No dwelling hereby permitted shall be first occupied until a scheme for the installation of bird boxes, bird bricks, bat boxes, habitat bat boxes and/or bat tubes has been submitted to and approved in writing by the Local Planning Authority. No dwelling hereby permitted shall be first occupied until the scheme has been implemented in full accordance with the approved scheme.

Reason: To provide a net gain in biodiversity in accordance with the National Planning Policy Framework and Policy DM15 of the Core Strategy and Development Management Policies (2009).
10) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.
To protect the character and appearance of the area and in the interest of highway safety in accordance with Policy DM3 of the Core Strategy and Development Management Policies Document.
11) The first floor windows in the southern side elevation of plot 3 hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows are installed.

Reason: To safeguard the privacy of occupiers of adjoining properties, in accordance with Policy DM3 of the Core Strategy and Development Management Policies (2009).
12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 2891/10/rev A; 2891/11/rev B; 2891/12/rev B; 2891/13/rev C

Reason: To identify the approved plans and to avoid doubt.
