Conditions or Reasons for Planning Application - CB/17/03252/VOC
Conditions or Reasons:
1) Before the access is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the highway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained in perpetuity free of any obstruction to visibility exceeding a height of 600mm above the adjoining foot way level.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

2) The development hereby permitted shall not be brought into use until visibility splays have been provided at the junction of the access with the public highway. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43m measured from the centre line of the proposed access along the line of the channel of the public highway. The required vision splays shall be maintained thereafter free of any obstructions to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

3) The new access shall not be brought into use until details showing the closing of any existing access within the highway frontage of the land to be developed, not incorporated in the access hereby approved have been submitted to and approved in writing by the Local Planning Authority and the accesses have been closed in accordance with the approved details.

Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway.

4) Before the premises are occupied all on site vehicular areas shall be surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure acceptable parking of vehicles outside highway limits .

5) No development shall take place until wheel-cleaning facilities which prevent the deposit of mud or other extraneous material on the highway during the construction period have been installed at all vehicular site exits and made operational and the Site Developer shall ensure that these are used by all vehicles exiting the site until the development has been substantially completed or until the roadworks necessary to provide adequate and clean access to and from the public highway have been completed (apart from final surfacing).

Reason: In the interests of the amenity and to prevent the deposit of mud or other extraneous material on the highway during the construction period.

6) The approved 'on site parking scheme for construction workers' in association with planning permission ref: CB/16/00954/FULL shall be implemented throughout the construction period.

Reason: To ensure adequate off street parking during construction in the interests of road safety.

7) The development hereby permitted shall not be occupied until the cycle stores shown on drawing no. 15-12-PL-001 have been implemented and thereafter retained for this purpose.

Reason: To ensure the provision of cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport.

8) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), any parking space hereby permitted shall be kept permanently available for the parking of motor vehicles.

Reason: To ensure that off-street parking is retained in the interests of highway safety.

9) The planting and landscaping scheme shown on the "Landscape Proposals" plan prepared by Devonshire Landscape Design, dated May 2016 (Drawing No. 10036) shall be implemented by the end of the full planting season immediately following the completion of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

10) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no windows shall be inserted into any flank elevation of the proposed dwellings, without the grant of further specific planning permission from the Local Planning Authority.

Reason: To protect the privacy of neighbouring residents.

11) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
12) The works shall be constructed in accordance with the approved boundary treatment details associated with condition 15 of planning permission CB/16/0954/FULL.

Reason: In the interest of pedestrian safety.

13) The development hereby approved shall only be implemented in full accordance with the approved archaeological scheme, Barker, J (2016) The Old Police Station, Eaton Bray, Bedfordshire: Written Scheme of Investigation for a Programme of Archaeological Observation, Investigation, Recording, Analysis and Publication. Albion Archaeology document 2016/155, version 1.1 dated 7th September 2016 associated with condition 16 of planning permission SB/16/0954/FULL.

Reason: A failure to secure appropriate archaeological investigation would be contrary to paragraph 141 of the National Planning Policy Framework (NPPF) that requires developers to record and advance of understanding of the significance of any heritage assets to be lost (wholly or in part) as a consequence of the development.
14) No part of the development hereby approved shall be occupied or brought into use until the approved drainage scheme shown on drawing no. 11693 / 01A has been implemented.

Reason: To ensure that adequate surface water drainage is provided and that existing and future land drainage needs are protected.

15) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 15-12-PL-001, 15-12-PL-002, 15-12-PL-003, 15-12-PL004, 15-12-PL-006, 15-12-PL-007, 15-12-PL-008 & "Landscape Proposals" plan prepared by Devonshire Landscape Design, dated May 2016 (Drawing No. 10036) & 11693 / 01A.

Reason: To identify the approved plans and to avoid doubt.
