Conditions or Reasons for Planning Application - CB/17/04912/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality, in accordance with Policy DM3 and CS14 of the Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. This information is required prior to commencement, as the development cannot be constructed without the external materials.
3) Prior to the commencement of development, details of the improvements to the junction of the proposed vehicular access with the highway shall be submitted to the Local Planning Authority for approval in writing. No development shall commencement until the junction has been constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. The details and works are required prior to commencement of the development, as otherwise they would present an unacceptable impact in terms of highways safety.
4) The access road from the public highway to the main parking area shall have a minimum width of 4.1m with lateral clearance of 0.3m on either side of that access.

Reason: In the interest of road safety and for the avoidance of doubt, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
5) Prior to the commencement of the development, hereby approved, details of the parking arrangements and management, as shown on drawing number 17.163/100 Rev. P.6, shall be submitted to the Local Planning Authority for approval in writing. The development shall not be occupied until those parking spaces have been constructed in accordance with the approved details.

Reason: In the interests of highways safety, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. The details and works are required prior to commencement of the development, as otherwise they would present an unacceptable impact in terms of highways safety.
6) Vision splays shall be provided on each side of the access drive and shall be 2.8m measured along the back edge of the new highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the dwelling occupier's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the new estate road and the new individual accesses, and to make the accesses safe and convenient for the traffic which is likely to use them, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
7) The maximum gradient of the vehicular access shall be 10% (1 in 10).

Reason: In the interests of the safety of persons using the access and users of the highway, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
8) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
9) Prior to the occupation of the development, hereby approved, all on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
10) Prior to the commencement of the development, hereby approved, details of refuse storage area and collection point shall be submitted to the Local Planning Authority for approval in writing. The development shall not be occupied until the said storage and collection points have been constructed in accordance with the approved details.

Reason: To ensure the refuse collection bins do not cause a hazard or obstruction to the highway or parking area, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. These details are required prior to commencement, as the location of the storage/collection points would influence the location of landscaping and wider development.
11) No development shall take place until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.These details are required prior to commencement, as they landscaping may influence the locaiton of other elements of the development, such as bin storage and collection.
12) Prior to the commencement of the development, hereby approved, details of secure cycle storage for residents and cycle parking for visitors shall be submitted to the Local Planning Authority for approval in writing. The development shall not be occupied until the said storage and parking have been constructed in accordance with the approved details.

Reason: In order to promote sustainable modes of transport, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. The details are required prior to commencement as the location of the storage may limit and impigne on other elements of the development, such as landscaping and waste storage.
13) Before the new access is first brought into use, any existing access within the frontage of the land to be developed, not incorporated in the access hereby approved shall be closed in a manner to the Local Planning Authority's written approval.

Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
14) Prior to the occupation of the development, hereby approved, 2 x integral swift bricks should be incorporated into the western elevation of plot 1.

Reason: In order to provide a net gain to biodiversity in accordance with the National Planning Policy Framework, Policies CS18 and DM15 of Central Bedfordshire Council's Core Strategy and Development Management Policies Development Plan Document and the emerging Central Bedfordshire Council Development Strategy.
15) Prior to the commencement of development, a scheme for protecting the proposed dwellings from noise and from the adjacent pub, its patrons and live and recorded entertainment, based on a professional acoustic assessment,shall be submitted to the Local Planning Authority for approval in writing. None of the dwellings shall be occupied until such the scheme has been implemented in accordance with the approved details, and shown to be effective. The scheme shall be retained in accordance with those details thereafter.

Reason: To protect the future occupiers from pollution, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF. This information is required prior to commencement of the development, as the construction of the development may limit and reduce the ability of any mitigation measures to protect residential amenity.
16) The first floor window in the north-eastern elevation of the development, hereby permitted, shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed. No further windows or other openings shall be formed in the north-eastern elevation.

Reason: To safeguard the privacy of occupiers of adjoining properties, in accordance with Policy DM3 and CS14 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
17) This approval relates only to the details shown on the submitted plans, numbers 17.163/100 Rev.P6, 17.163/101 Rev.P1 and 17.163/102 Rev.P3.

Reason: To identify the approved plans and to avoid doubt.
