Conditions or Reasons for Planning Application - CB/17/04920/VOC
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All materials to be used for the external walls (including the provision of 1 bird brick per unit) and roofs of the development hereby approved shall accord with the details approved pursuant to condition 2 of planning permission CB/17/00556/FULL.

Reason: Materials are required to be ordered in advance of the construction phase and to control the appearance of the building in the interests of the visual amenities of the locality and to ensure a net gain in biodiversity. (Policy DM3 of the Core Strategy for the North and Sections 7 and 11, NPPF)
3) All hard and soft landscaping shall be carried out in accordance with the details shown on Plan W101B. The approved landscaping scheme shall be implemented by the end of the full planting season immediately following the first use of any part of the development (a full planting season means the period from October to March).

Reason: To ensure an appropriate standard of landscaping.

4) The boundary treatment shall be completed in accordance with drawing 101B before any dwelling is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details, and any surplus lengths of existing access closed and re-instated.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
(Policy DM3 of the Core Strategy for the North and Section 4 of the NPPF).
6) Prior to the commencement of any above ground works the replacement parking provision of 9 parking bays measuring 2.5m x 5.0m each and access thereto shall be constructed in accordance with the approved details shown on drawing no. W104. The proposed vehicular accesses/replacement parking bays shall be surfaced in bituminous or other similar durable material (not loose aggregate) for a distance of 5.0m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To ensure adequate replacement parking provision as mitigation for the loss of the garage parking and to prevent resultant highway safety issues.

7) The lockable bollards in the replacement parking bays shall be constructed clear of the public highway and lower into the parking bay and not the public highway

Reason: For the avoidance of doubt and to avoid obstruction of the footway.

8) No flat shall be occupied until, a finalised 'Maintenance and Management Plan' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities, has been submitted and approved in writing by the Local Planning Authority. The approved surface water drainage scheme shall be correctly and fully installed as per the final approved details and retained in perpetuity.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161.
9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers P100G, W101B, W104.

Reason: To identify the approved plans and to avoid doubt.
