Conditions or Reasons for Planning Application - CB/17/05443/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of adjacent properties on Hinksley and Catherine Road.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match existing dwellings in the interests of the visual amenities of the locality.

3) No development shall take place until details of the existing site levels including the floor level of the dwelling at number 9 Hinksley Road, Flitwick and the finished floor levels of the proposed dwelling house have been submitted to and approved in writing by the Local Planning Authority. Thereafter the site shall be developed in full accordance with the approved details.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

This pre-commencement condition is necessary in order to ensure that no unnecessary harm is caused by the commencement of development works.
4) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building(s) hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building(s) in the interests of the amenities of the area.

5) No work shall commence on the external finishes of the dwelling hereby approved until details of a refuse storage area and collection point have been submitted to and approved in writing by the Local Planning Authority and prior to occupation of the dwelling the works shall be constructed in accordance with the approved details.

Reason: To ensure the refuse collection bins do not cause a hazard or obstruction to the highway or parking area.
6) Before development of the 'new' dwelling commences, the replacement garage parking with 5.0m length parking space in front shall be constructed.

Reason: For the avoidance of doubt and to provide adequate replacement parking provision clear of the public highway.
7) Before the widened access is first brought into use, a triangular vision splay shall be provided on each side of the widened access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the highway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the widened access, and to make the access safe and convenient for the traffic which is likely to use it.
8) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the replacement garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.
9) The maximum gradient of the vehicular access shall be 10% (1 in 10).

Reason: In the interests of the safety of persons using the access and users of the highway.
10) All the on site vehicular areas shall be constructed and surfaced in bituminous or other similar durable material (not loose aggregate) and arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits .
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers; 1A existing roof plan; 1A proposed elevations; 2A proposed elevations; 3A proposed roof plan; 4A existing elevations; 5A revised floor and site plan; 6B location plan.

Reason: To identify the approved plan/s and to avoid doubt.
