Conditions or Reasons for Planning Application - CB/17/05896/FULL
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt, where permission will not be granted except in very special circumstances for development for purposes other than the specified purposes listed in paragraphs 89 and 90 of the National Planning Policy Framework. The retrospective development is not included within these specified purposes and thus constitutes inappropriate development within the Green Belt. The proposed double garage, by reason of its bulk, mass and location would also have a significant detrimental impact on the openness of the Green Belt. No very special circumstances have been established in this case and thus the proposal is in conflict with Section 9 of the National Planning Policy Framework and policy SP4 of the emerging Local Plan 2015-2035 and the Central Bedfordshire Design Guide.
2) The retrospective development would, because of its scale, bulk, mass, height and siting on the boundary fronting the highway, appear unduly dominant and overbearing and would be out of character with the streetscene and the visual amenities of the Conservation Area.The proposal is therefore contrary to the principles of good design as set out within Sections 7 & 12 of the National Planning Policy Framework, Policy BE8 of the South Bedfordshire Local Plan Review, policies HQ1 & HE3 of the submission of the Local Plan 2015-2035 and the Central Bedfordshire Design Guide.
3) The application contains insufficient information about the significance of the surrounding trees, all protected under Section 211 of the Town and Country Planning Act 1990, by virtue of them being located within the Great Billington Conservation Area. No BS 5837 : 2012 Tree Survey or Tree Constraints Plan has beeen submitted to determine the impact the development would have on these assets. The proposed development would cause harm to the Conservation Area and no justification has been provided to outweigh that harm. The proposal is therefore contrary to Section 12 of the National Planning Policy Framework, Policy BE8 of the South Bedfordshire Local Plan Review, policies HQ1 & HE3 of the submission of the Local Plan 2015-2035 and the Central Bedfordshire Design Guide.
