Conditions or Reasons for Planning Application - CB/18/00339/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Unless otherwise agreed in writing, the development hereby approved shall be carried out in strict accordance with the material details shown on drawing nos. 17-210.COU.05/ REV. C, 17-210.COU.11/ REV. C and 17-210.COU.18/ REV. C, the materials detailed on Page 3 of the submitted application form dated 25.01.18 as well as the materials stated on Page 6 of the supporting planning statement dated January 2018 and with reference 17/374.

Reason: To control the appearance of the buildings in the interests of the visual amenities of the Green Belt and of the AONB and AGLV.
(Policies NE3 & BE8, SBLPR, policy HQ1 & EE4 of the emerging Central Bedfordshire Local Plan and sections 7, 9 & 11, NPPF)
3) Before development is commenced, details of the extent and means of definition of the curtilage of each of the residential units shall be submitted to and approved in writing by the Local Planning Authority and the boundaries of the curtilage shall be set out and defined in accordance with the approved details before each unit is first occupied or brought into use including a scheme for screen fencing and/or screen walling and thereafter retained.

Reason: To limit the extent of the residentially used land having regard to the rural location of the site in the Green Belt, the Chilterns Area of Outstanding Natural Beauty and the Area of Great Landscape Value.

4) Prior to the commencement of the development hereby approved, an ecological enhancement strategy and a management plan for the meadow and wild flower area shown on drawing no. 17-210.COU04 Rev C, shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall thereafter be implemented the are shall be maintained in accordance with the approved management plan.

Reason: This is a pre-commencement condition to ensure that habitat enhancement measures are satisfactory in order to ensure that the proposal is in line with NPPF guidance requiring the delivery of a net gain for biodiversity.

4) Prior to the commencement of the development hereby approved, an ecological enhancement strategy and a management plan for the meadow and wild flower area shown on drawing no. 17-210.COU04 Rev C, shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall thereafter be implemented the are shall be maintained in accordance with the approved management plan.

Reason: This is a pre-commencement condition to ensure that habitat enhancement measures are satisfactory in order to ensure that the proposal is in line with NPPF guidance requiring the delivery of a net gain for biodiversity.

5) Prior to development (including demolition), a Tree and Hedge Protection Plan shall be submitted to the Local Planning Authority for approval, and shall be for the purpose of protecting all boundary planting (including areas being proposed for new planting), and retained trees from development activity. The approved Tree and Hedge Protection Plan shall
then be fully implemented before the commencement of development (including demolition), with the protective barrier fencing remaining securely in position throughout the entire course of development works.

Reason: The condition must be discharged prior to commencement to secure the protection of retained planting, including areas being proposed for new planting, from damage incurred through development activity, to ensure their continued health, amenity and screening value, and to provide a good rooting medium for new planting stock.

6) No development shall take place until a written scheme of archaeological investigation; that includes provision for post excavation analysis and publication, has been submitted to and approved in writing by the Local Planning Authority. The development hereby approved shall only be implemented in full accordance with the approved archaeological scheme.'

Reason: This condition is pre-commencement as a failure to secure appropriate archaeological investigation in advance of development would be contrary to Section 16 of the National Planning Policy Framework (NPPF) that requires developers to record and advance of understanding of the significance of any heritage assets affected by development before they are lost (wholly or in part). (Section 16, NPPF)
6) No development shall take place until a written scheme of archaeological investigation; that includes provision for post excavation analysis and publication, has been submitted to and approved in writing by the Local Planning Authority. The development hereby approved shall only be implemented in full accordance with the approved archaeological scheme.'

Reason: This condition is pre-commencement as a failure to secure appropriate archaeological investigation in advance of development would be contrary to Section 16 of the National Planning Policy Framework (NPPF) that requires developers to record and advance of understanding of the significance of any heritage assets affected by development before they are lost (wholly or in part). (Section 16, NPPF)
7) No development other than ground works shall take place until a landscaping scheme to include all hard and soft landscaping, including soft landscaping to the site boundaries, and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping in the interests of the character and appearance of the Area of Outstanding Natural Beauty and Area of Great Landscape Value.

8) The vehicular access shall be surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 5m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway.

9) The development shall not be brought into use until a turning space for light goods vehicles has been constructed within the curtilage of the site in a manner to be approved in writing by the Local Planning Authority.

Reason: To enable vehicles to draw off, park and turn outside of the highway limits thereby avoiding the reversing of vehicles on to the highway.

10) The refuse collection point as shown on the approved drawing number 17-210.COU.04 rev B shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.

Reason In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises.

11) Development shall not commence until a scheme detailing provision for on site parking for construction workers for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period.

Reason: The condition must be discharged prior to commencement to ensure adequate off street parking during construction in the interests of road safety.

12) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:
A Phase 1 Desk Study report documenting the ground conditions of the site with regard to potential contamination;
A Phase 2 Site Investigation  (where shown as necessary the Phase 1 Desk Study);
A Phase 3 Remediation Scheme (where shown as necessary by the Phase 2 Site Investigation)

All such work shall be undertaken in accordance with BS:10175:2011 or other appropriate guidance issued by the regulatory authorities. The work shall be sufficient to ensure that measures will be taken to mitigate any risks to human health and the wider environment.

Reason: The condition must be discharged prior to commencement to protect human health (including construction workers) and the environment.

12) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:

13) Notwithstanding the provisions of Part 1 Class A of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification) no extensions of the buildings hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of protecting the visual amenity of the AONB, AGLV and openness of the Green Belt.

14) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of any of the properties hereby permitted without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of protecting the visual amenity of the AONB, AGLV and openness of the Green Belt.

15) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no fences, gates, walls or other means of enclosure shall be erected within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the rural amenity of the area.

16) No development shall take place until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of fire hydrants at the development. Prior to the first occupation of the dwellings the fire hydrant(s) serving that development shall be installed as approved. Thereafter the fire hydrant(s) shall be retained as approved in perpetuity.

Reason: The condition must be discharged prior to commencement to ensure that ground works do not prejudice the appropriate siting of fire hydrants, in the interests of fire safety and providing safe and accessible developments.

17) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Council's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
18) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 17-210.COU.01/ REV.
