Conditions or Reasons for Planning Application - CB/18/01042/LB
Conditions or Reasons:
1) The proposed development, in scale and design, fails the 'Statutory test' set out in section 66 of the 1990 Planning (Listed Buildings and Conservation Areas) Act in respect of preserving the (listed) building and its setting. In NPPF terms, it is also considered that the scale and design of the proposal would cause less than substantial harm to the designated heritage asset and no clear justification or public benefit has been demonstrated, which is contrary to the NPPF, DM13 and CS15 of the Core Strategy and Development Management Policies North (2009).
