Conditions or Reasons:
1) Definition of the Permission
The planning permission shall extend to the area edged with a solid red line on the attached Plan No. CB/18/01252/MW-1 (Drawing No. S165-00137-14 entitled 'Application Plan'). The development hereby permitted shall be carried out in accordance with particulars of the development, drawings and specifications contained within the planning application. The approved drawings and particulars (except where modified by other conditions of this permission) comprise the following:

Reason: To ensure that the development is carried out in an acceptable manner and to provide certainty as to what is being authorised by this permission.
2) Time Limits
The development hereby permitted shall be begun not later than the expiration of 3 years from the date of this permission. Written notification of the date of commencement of the development shall be sent to the Local Planning Authority within 7 days of such commencement.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004 and to enable the Local Planning Authority to monitor other conditions of this permission.
3) No mineral extraction shall take place after a period of 20 years from the date of this permission. Final restoration and landscaping works, but excluding aftercare requirements, shall be completed within one year of the date of cessation of mineral extraction.
Reason: To ensure that the development is completed within an acceptable timescale and to prevent prolonged disturbance to the local environment in accordance with Saved Policies GE18 and GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
4) Phasing
The site shall be worked in phases as set out on the Block Phasing Plan Drawing No. S165-00137-12 and detailed in the series of phasing plans Drawing Nos. S165-00137-2 (Phase 2B) to S165-00137-10 (Final Restoration Works). Extraction in each phase shall not proceed without the written consent of the Local Planning Authority which shall depend upon satisfactory progress in the restoration of the previous phases in accordance with the approved scheme.
Reason: To ensure the satisfactory restoration of the site within a reasonable timescale in accordance with Saved Policy GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
5) Access
No access to, or egress from, the site shall be taken except via the existing site access road off the B658.
Reason: To minimise the danger, obstruction and inconvenience to highway users in accordance with Saved Policy GE23 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
6) Vehicle Movements
No more than a maximum of 94 HGVs associated with the development hereby permitted shall leave the site in a normal working day (pro rata for part Saturdays). Records of all HGVs leaving the site shall be maintained and shall be made available for inspection or a summary forwarded to the Local Planning Authority within 7 days of a written request.
Reason: In the interest of highway safety.
7) All HGVs entering and leaving the site, including those associated with the aggregate packing plant, shall be monitored using the CCTV at the quarry entrance, to which the Local Planning Authority shall at all times be afforded remote access to view live and historic footage.
Reason: To facilitate monitoring of traffic movements and hours of operations and to ensure compliance with Conditions 6 and 28.
8) No stripping of topsoil, subsoil or overburden shall take place except in accordance with the MAFF (2000) 'Good Practice Guide for Handling Soils'. No stripping of topsoil, subsoil or overburden shall commence in the northern extension area until a Soil Management Scheme has been submitted to and approved by the Local Planning Authority. The scheme shall include details of the location, height, width, batters and seeding of the storage bunds within the overall 'red line' permitted site referred to in Condition 1.
Soils and overburden shall only be removed when the materials can be handled without damage to their structure.

Reason: To safeguard soil resources and provide for the satisfactory restoration of the site in accordance with Saved Policy GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
9) The storage of minerals shall be confined to the plant site area and the height of the stockpiles shall not exceed the height of the surrounding screen bunds.
Reason: In the interests of visual amenity and to accord with Saved Policy GE9 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
10) No materials shall be brought onto the site for processing or storage other than materials for use in the aggregate packing plant as permitted under Planning Ref. No. CB/18/04304/MW.
Reason: To protect the amenities of the area in accordance with Saved Policy GE9 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005 and to restrict the development to that applied for.
11) Erection of Buildings, Plant and Machinery
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no building, structure, fixed plant or machinery shall be installed, extended, erected or replaced on the site beyond the plant site which benefits from Permitted Development rights, as shown hatched on Drawing No. S165_00162-1 dated 6 December 2019 and received by the Local Planning Authority on 22 April 2020, without the benefit of express planning permission.
Reason: To enable the Local Planning Authority to exercise control over any development within the site which could be detrimental to the amenities of the area and to accord with Saved Policy GE9 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
12) All buildings, foundations, pads, plant and machinery shall be removed from the site when they are no longer required for the purposes for which they were erected or installed or within six months from the date of cessation of mineral extraction, whichever is the sooner, and all land covered by such buildings, foundations, pads, plant and machinery shall be restored in accordance with the approved scheme required to be submitted to the Local Planning Authority under Condition 35 of this permission.
Reason: To provide for the satisfactory restoration of the site within a reasonable timescale in accordance with Saved Policy GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
13) No external lighting shall be installed except in accordance with a scheme which has been submitted to and approved by the Local Planning Authority. The lighting shall thereafter only be installed in accordance with the details of the approved scheme.
Reason: To protect the amenities of the area and to accord with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
14) Archaeology
No development shall take place in the northern extension area until an Archaeological Written Scheme of Investigation (AWSI) has been submitted to and approved in writing by the Local Planning Authority. The AWSI shall include the following information:
a. A method statement for the investigation of all archaeological remains present at the site that will be destroyed by the development;
b. A strategy for community engagement;
c. An outline strategy for post-excavation assessment, analysis and publication; and
d. A timetable for each stage of the archaeological works.
The scheme as may be approved shall be implemented in full.

REASON: To record and advance the understanding of the significance of all heritage assets with archaeological interest which will be unavoidably destroyed as a consequence of the development and to make the record of this work publicly available in accordance with Paragraph 199 of the NPPF. To accord with Saved Policy GE14 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005 to ensure that provision is made for an appropriate level of investigation and recording in advance of the destruction of those archaeological remains which do not merit permanent preservation.
15) The archaeological post-excavation assessment and preparation of an Updated Project Design shall be completed no later than one year after the completion of archaeological fieldwork. The Updated Project design shall follow the parameters set out in the outline strategy for post-excavation assessment, analysis and publication agreed in the Written Statement of Investigation as may be approved by the Local Planning Authority under Condition 14. The Updated Project Design shall be submitted to the Local Planning Authority for its approval in writing.
Reason: To accord with paragraph 199 of the NPPF and to ensure that the record of archaeological work is made publicly available.
16) The archaeological post-excavation analysis (as specified in the Updated Project Design); the preparation of the site archive for deposition with a store approved by the Local Planning Authority; the completion of the archive report and the submission of the publication report shall be undertaken within two years of the approval of the Updated Project Design.
Reason: To accord with paragraph 199 of the NPPF to ensure that the record of archaeological work and any associated archives are made publicly available.
17) No topsoil shall be removed from any future working phase unless and until 1 month's notice in writing has been given to the Local Planning Authority of the intended start date for soil stripping operations to enable archaeological inspection of the site to be carried out.
Reason: To enable the preservation, protection, management and recording of hitherto hidden archaeological features in accordance with Saved Policy GE14 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
18) Ecology
No tree, shrub, scrub or other vegetation removal shall be carried out during the bird nesting season (March to August inclusive) unless the vegetation identified for removal has been immediately prior checked by a suitably qualified ecologist to prove that no nesting birds are present and appropriate advance measures put in place to provide necessary protection to the written approval of the Local Planning Authority.
Reason: To avoid disturbance to nesting birds in the interests of nature conservation and to accord with Saved Policy GE13 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
19) No tree, shrub, scrub or other vegetation removal shall be carried out unless a survey of foraging and nesting of barn owls has been undertaken by a suitably qualified and licenced ecologist and submitted to the Local Planning Authority for its approval in writing. Development shall be carried out in accordance with details as may be approved.
Reason: To avoid disturbance to barn owls on site in the interests of nature conservation and to accord with Saved Policy GE13 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
20) No felling or removal of limbs of trees from mature trees shall be carried out unless and until a survey for roosting bats has been undertaken by a suitably qualified ecologist. Should the species be found to be present, an appropriate compensation/mitigation strategy accompanied by a programme for its implementation shall have been submitted to and approved in writing by the Local Planning Authority before any such tree works commence. Thereafter, no development shall be carried out except in accordance with the approved strategy.
Reason: To safeguard protected or rare species that may be present and to accord with Policy GE13 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
21) No entry shall be made into any phase of operations for the purposes of soil stripping unless and until a badger survey of the land to be stripped has first been undertaken by a suitably qualified ecologist and submitted to the Local Planning Authority. Should the species be found to be present, an appropriate compensation/mitigation strategy accompanied by a programme for its implementation shall have been submitted to and approved in writing by the Local Planning Authority before any stripping operations commence. Thereafter, no development shall be carried out except in accordance with the approved strategy.
Reason: To safeguard protected or rare species that may be present and to accord with Policy GE13 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
22) Protection of Water Resources/Prevention of Flooding
If, during development, contamination not previously identified is found to be present at the site then no further development shall be carried out until the developer has submitted a remediation strategy detailing how this unsuspected contamination shall be dealt with and obtained approval in writing from the Local Planning Authority. The unsuspected contamination shall thereafter be dealt with in accordance with the remediation strategy as may be approved.
Reason: To protect and prevent the pollution of controlled waters and to provide for the satisfactory restoration of the land in accordance with Saved Policies GE17, GE20 and GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005 and paragraphs 170 and 178 of the NPPF.
23) No mineral extraction shall take place from the northern extension area unless and until a scheme for the monitoring, control and maintenance of groundwater levels and the water levels in the fishing ponds and Eastern Ditch (IDB Watercourse No. 121) has been submitted to and approved in writing by the Local Planning Authority. The monitoring results shall be reported quarterly to the Local Planning Authority.

Reason: To safeguard groundwater levels and the ecological functioning of the Eastern Ditch in accordance with Saved Policy GE20 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
24) The development hereby permitted shall be carried out in accordance with the measures and recommendations set out in the Flood Risk Assessment dated 16 October 2017.
Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction in flood storage capacity of the site in accordance with Saved Policy GE19 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
25) No mineral extraction shall take place within the northern extension area unless and until a detailed scheme for the surface water drainage disposal, including arrangements for management and maintenance, has been submitted to and approved in writing by the Local Planning Authority. Infiltration systems shall only be used where it can be demonstrated that they do not pose a risk to groundwater quality. The development shall be carried out in accordance with the scheme details as may be approved.

Reason: To protect and prevent the pollution of controlled waters and to provide for the satisfactory restoration of the land in accordance with Saved Policies GE17, GE20 and GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005 and paragraphs 170 and 178 of the NPPF.
26) No mineral extraction shall take place within the northern extension area unless and until a revised Hydrological Monitoring Scheme has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include all on site boreholes, as well as groundwater level and surface water level monitoring of points identified in Chapter 9 of the Environmental Statement dated March 2018. A monitoring report shall be submitted to the Local Planning Authority every year throughout the duration of the scheme and baseline monitoring of offsite locations shall be undertaken.

Reason: To protect and prevent the pollution of controlled waters and to provide for the satisfactory restoration of the land in accordance with Saved Policies GE17, GE20 and GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005 and paragraphs 170 and 178 of the NPPF.
27) All oil, fuel and/or chemical storage tanks, buildings and ancillary handling facilities such as pumps and valves shall be contained within an impervious bunded area, the capacity of which shall be at least 110% of the tank capacity, and all fluids shall be handled in accordance with the Fluids Storage, Handling and Spillage Remediation Protocols.
Reason: To prevent contamination of the groundwater in accordance with Saved Policy GE17 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
28) Hours of Operation
No operations authorised or required under this permission shall be carried out except between the following times:
07:00 to 18:00 hours Mondays to Fridays; and
07:00 to 13:00 hours Saturdays.
No operations shall be carried out on Sundays, Public or Bank Holidays.
Notwithstanding the above:
up to two employees may be permitted to enter the site between 06:30 and 07:00 hours Monday to Saturday to remove security measures at the site.
For temporary operations such as site preparation, soil and overburden stripping, screening bund formation and removal and final restoration or where noise levels are likely to exceed 55dB(A) 1hr, free field at sensitive receptors, operations shall not commence before 08:00 hours on any day.
Reason: To safeguard the amenities of the area in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
29) Noise
No soil stripping shall take place within the northern extension area unless and until an updated scheme for the monitoring and control of noise has been submitted to and approved in writing by the Local Planning Authority. The updated scheme shall include:
Noise monitoring and recording procedures;
Monitoring results to be supplied to the Local Planning Authority within 1 month of monitoring;
Noise suppression measures;
Details of broadband 'white' noise reversing alarms or other suitable non-audible reversing aids maintained in accordance with the manufacturers' recommendations and specifications; and
Procedures to be adopted in the event of complaints or the maximum permitted noise levels being exceeded.
The measures set out in the updated scheme shall thereafter be implemented for the duration of operations in accordance with the details as may be approved. In the event that inadequacies are demonstrated, or custom and practice benchmarks change, the scheme shall, upon the request of the Local Planning Authority, be reviewed and a revised version be submitted to the Local Planning Authority for its approval writing. The revised version shall be implemented in accordance with the details as may be agreed.

Reason: To minimise disturbance to nearby residents by reason of noise and to enable the effects of the development to be adequately monitored during the course of operations in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
30) Except for temporary operations, the free field Equivalent Continuous Noise level, LAeqT, due to operations in the site, shall not exceed the relevant site noise limit specified in Schedule 1 at each selected dwelling/location. Measurements taken to verify compliance shall have regard to the effects of extraneous noise and shall be corrected for such effects.

Reason: To minimise disturbance to nearby residents by reason of noise and enable the effects of the development to be adequately monitored during the course of the operations in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
31) For temporary operations such as site preparation, soil and overburden stripping, screening bund formation and removal and final restoration, the free-field noise level due to work at the nearest point to each dwelling shall not exceed 70dBLAeq,1hr expressed in the same manner as for Condition 30. Temporary operations shall not exceed a total of eight weeks in any calendar year for work close to any individual noise sensitive premises.
Reason: To minimise disturbance to nearby residents by reason of noise in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
32) All vehicles, plant and machinery operated within the site shall be maintained in accordance with manufacturers' specifications and recommendations at all times, and shall be fitted with and use effective silencers.
Reason: To minimise disturbance to nearby residents by reason of noise in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
33) Dust
No soil stripping shall take place in the northern extension area unless and until an updated Dust Control Monitoring Scheme (DCMS) has been submitted and approved in writing by the Local Planning Authority. The updated scheme as may be approved shall be implemented for the duration of operations and monitoring results forwarded to the Local Planning Authority in accordance with the scheme.
In the event that inadequacies are demonstrated, or custom and practice benchmarks change, the scheme, shall upon the request of the Local Planning Authority, be reviewed and a revised version be submitted to the Local Planning Authority for its approval writing. The revised version shall be implemented in accordance with the details as may be agreed.

Reason: To minimise any nuisance to nearby residents by reason of dust in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
34) The wheel cleaning facility at the site exit shall be maintained in good working order throughout the life of the development and shall be used at all times by HGVs exiting the site.
Reason: To prevent the deposit of mud or other extraneous material on the public highway in the interests of road safety and in accordance with Saved Policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
35) Landscaping, Restoration and Aftercare
No entry shall be made into Phase 4 (North) within the northern extension area (as depicted on Drawing S165-00137-12 (Block Phasing)) for soil stripping purposes unless and until a detailed scheme for the restoration of the land has been submitted to and approved by the Local Planning Authority. The detailed scheme, which shall be broadly in accordance the details shown on:
Drawing No. M00.131(j).D.022A (Concept Restoration) dated December 2018;
Drawing No. S165-00137-17 (Concept Restoration North Eastern Lake (Illustrative Scheme)) dated January 2019; and
Drawing No. S165-00137-16-A (Typical Detailed Proposals for North Eastern Lake) dated January 2019
shall include the following:
i) The landform and water areas with details of finished contours at 0.5m intervals, soil depths, arrangements for land drainage and water levels;
ii) Implementation of the public rights of way and permissive routes to include layout of the routes, links to existing rights of way and access points, viewing areas, details of path widths, surfacing and maintenance;
iii) Landscaping details including grass seeding for meadow, marshy grassland, agricultural land; agricultural wildlife buffer zones and species, numbers, sizes, spacing and location of trees and shrubs to be planted together with provisions for ground treatment prior to planting.
iv) Measures to protect the ecological habitats from the potential use of fertilisers and pesticides on the agricultural areas;
v) A slope stability report to demonstrate that any slopes remaining post-restoration will remain stable in the long-term;
vi) A timetable for progressive implementation within each phase to achieve the required afteruse and source of material to be used to achieve restoration profiles.
The development shall be carried out in accordance with the scheme and timetable as may be approved and completed within one year of the cessation of mineral extraction at the site.
Reason: To provide for the satisfactory restoration of the site in accordance with Saved Policies GE21 and GE26 of Bedfordshire and Luton Minerals and Waste Local Plan 2005.
36) Within 1 month of the completion of the final restoration landform within each phase, a topographical survey of the site shall be carried out at 0.5m contour intervals (to Ordnance Survey Newlyn) and the survey results submitted to the Local Planning Authority within 21 days of the date on which the survey was conducted for its written approval.
Reason: To enable ground levels to be checked in order to provide for the satisfactory restoration of the site in accordance with Saved Policies GE26 and GE27 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
37) No entry shall be made into Phase 4 (North) within the northern extension area as depicted on Drawing S165-00137-12 (Block Phasing) for soil stripping purposes unless and until a scheme for the aftercare and management of the restored land shall be submitted to the Local Planning Authority for its approval in writing. The scheme shall include:
An outline strategy in accordance with national planning policy guidance for the five year aftercare period specifying the steps to be taken and the period during which they are to be taken and including an annual aftercare meeting;
A detailed annual programme, to be submitted to the Local Planning Authority not later than one month prior to an annual aftercare meeting; and
The implementation of the aftercare and management scheme and a Biodiversity Action Plan shall be carried out progressively and completed within five years of the completion of restoration of the final phase.
Aftercare and management of the restored land shall take place in accordance with the scheme as may be approved.
Reason: To provide for the satisfactory restoration and aftercare of the site in accordance with Saved Policies GE26 and GE27 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
38) There shall be no entry into the northern extension area unless and until a Landscape and Ecological Management Plan (LEMP) has been submitted to the Local Planning Authority for its approval in writing. The LEMP shall include:
i) A description and evaluation of features to be managed;
ii) Ecological trends and constraints on site that might influence management (including up to date assessment of ecological interest);
iii) Aims and objectives of management;
iv) Appropriate management options for achieving aims and objectives;
v) Prescriptions for management actions;
vi) Preparation of a work schedule (including annual work plan capable of being rolled forward following completion of the final restored scheme);
vii) Details of the body or organisation responsible for implementation of the plan; and
viii) Ongoing monitoring and remedial measures.
The plan shall also set out, where the results of monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan shall be implemented in accordance with the approved details.
[For the avoidance of doubt, the 'northern extension area' is that part of the planning application boundary which lies outside the red dashed line shown on Drawing No. S165-00137-14 (Application Plan)].
REASON: To protect and enhance the biodiversity of the site in accordance with Saved Policy GE13 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
39) Annual Sales
Details of annual sales and remaining reserves of minerals from the site shall be submitted to the Local Planning Authority by 31 March each year for the previous period from 1 January to 31 December. These details shall include the following:
Category of mineral (building sand/concreting sand/gravel);
Quantity of each category in tonnes; and
Remaining reserves as at 31 December for the reporting period.
Reason: To enable monitoring and assist the Local Planning Authority in the forward planning of mineral resources.
40) Annual Environmental Report
An Annual Environmental Report shall be submitted to the Local Planning Authority by 31 March each year for the previous period from 1 January to 31 December. The report shall contain the following:
A statement of operations over the past year, to include progress on mineral extraction and restoration, and a summary of monitoring of noise, dust, groundwater and traffic movements;
Identification of any problems caused by the operations and action taken to address these;
A statement of future planned operations over the next year; and
Identification of any potential problems which could be caused by future operations and the action to be taken to address these.
Reason: To enable monitoring, assess the environmental impact of the operations and assist the Local Planning Authority in the forward planning of mineral resources in accordance with Saved Policies GE18, GE20, GE26 and GE27 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
