Conditions or Reasons for Planning Application - CB/18/01682/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the details submitted with the application, and prior to commencement of the constructional phase of the development hereby approved, samples of the face brick and roof tiles proposed in the development hereby approved shall be made available on site for inspection by, and written approval of, the Local Planning Authority and the approved development shall be undertaken thereafter strictly in accordance with the approved details.

Reason: To ensure that the development is in keeping with the existing building.

3) Notwithstanding the details submitted with the application, the new window proposed to be installed as part of the development hereby approved shall be of painted timber construction, full details of which, including glazing bar profiles shown in comparison to the existing windows to be matched, window opening configurations demonstrating that the windows shall operate strictly in a traditional manner, and confirmation of intended depth of reveal, shall be submitted to and approved in writing by the Local Planning Authority to a scale of 1:10 or 1:20, prior to the commencement of development on site, and the approved development shall thereafter be implemented strictly in accordance with the approved details and shall be maintained as such thereafter.
Reason: To ensure that the proposed development/work is carried out in a manner that safeguards the historic character and appearance of the area.

4) Notwithstanding the details submitted with the application, and prior to commencement of the constructional phase of the development hereby approved, details of external finishes Schedule, including colour swatches, shall be submitted to and approved in writing by the Local Planning Authority and the approved development shall be undertaken thereafter strictly in accordance with the approved details.
Reason: To ensure that the development is carried out in a manner that safeguards the historic significance and character of the conservation area. (Policy BE, SBLPR and Section 12, NPPF)
5) Before the access is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it.

6) Visibility splays as shown on drawing number PL-01shall be provided at the junction of the access with the public highway before the development is brought into use. The required vision splays shall, on land in the applicant's control, be kept free of any obstruction, in excess of 0.6m in height.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it.

The proposed driveway shall be constructed and surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 5m into the site, measured from the highway boundary, before the new development is brought in to use.  Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway.

8) Before the new development is first brought into use, any existing access within the frontage of the land to be developed, not incorporated in the access hereby approved shall be closed in a manner to the Local Planning Authority's written approval.

Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway.

9) The turning space for vehicles illustrated on the approved Plan number PL-01 shall be constructed before the development is first brought into use and retained thereafter for that purpose.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway.

10) The proposed development shall be carried out and completed in all respects in accordance with the access siting and layout illustrated on the approved plan No.PL-01 and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 1995, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times.

11) Before the development is first occupied or brought into use, the parking scheme shown on plan no PL-01 shall be completed and thereafter retained for this purpose.

Reason: To ensure the provision of car parking clear of the highway.

12) The first floor window in the south elevation (facing New Road) of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window(s) which can be opened are more than 1.7m above the floor of the room in which the window is installed. No further windows or other openings shall be formed in the south and west elevations.

Reason: To safeguard the privacy of occupiers of adjoining properties

13) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL-01, PL-02 Rev A and PL-03.

Reason: To identify the approved plans and to avoid doubt.
