Conditions or Reasons for Planning Application - CB/18/01706/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No vehicle shall cross the footway until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
(Section 4, NPPF)
3) Before the access is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it. (Section 4, NPPF)
4) Visibility splays shall be provided at the junction of the access with the public highway before the development is brought into use.   The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43m measured either side from the centre line of the proposed access along the line of the channel of the public highway.  The required vision splays shall, on land in the applicant's control, be kept free of any obstruction.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it. (Section 4, NPPF)
5) The proposed driveway shall be constructed and surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 5m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway.
(Section 4, NPPF)
6) Any gates provided shall open away from the highway and be set back a distance of at least 5.0m from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened.
(Section 4, NPPF)
7) The maximum gradient of the vehicular access shall be 10% (1 in 10).

Reason: In the interests of the safety of persons using the access and users of the highway.
(Section 4, NPPF)
8) The access shall not be brought into use until a turning space for vehicles has been constructed within the curtilage of the site in a manner to be approved in writing by the Local Planning Authority.

Reason: To enable vehicles to draw off, park and turn outside of the highway limits thereby avoiding the reversing of vehicles on to the highway.
(Section 4, NPPF)
9) Before development begins, a parking scheme within the curtilage of the property, clear of the public highway, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall comply with the standards of the Local Planning Authority and shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To minimise the potential for on-street parking and thereby safeguard the interest of the safety and convenience of road users.
(Section 4, NPPF)
10) Prior to development, full details of a "no-dig" cellular confinement system shall be submitted to the Local Planning Authority for approval, along with an appropriate Arboricultural Method Statement and Tree Protection Plan, to be prepared by a suitably qualified arboriculturist, in respect of the construction of the driveway into the site and new parking area, as being required by the highway condition. The approved "No-Dig" cellular confinement system, Arboricultural Method Statement and Tree Protection Plan shall then be implemented in strict accordance with the recommended sequence of operations, both before and throughout the construction of the vehicular crossover and its associated works. The new driveway and parking area shall have a construction build specification that can withstand any future site usage, and intended vehicular traffic, that may need to use the new crossover at a later date.

Reason: To ensure that a satisfactory standard of tree protection is carried out when constructing the new driveway and parking areas, associated with the implementation of the new vehicular crossover, in the interests of maintaining tree health, stability and amenity value.
(Sections 7 & 11, NPPF)
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers Site Location Plan, Block Plan and 2018/0405/01.

Reason: To identify the approved plans and to avoid doubt.
