Conditions or Reasons for Planning Application - CB/18/02340/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans;

Document entitled Landscape Management and Maintenance Plan Marston Vale (April 2018)

Reason: To identify the approved plans and to avoid doubt, and in the interest of the character of the area in accordance Policies CS14, DM3 and DM14 of the Core Strategy and Development Management Policies 2009.
3) Prior to first use of the development hereby approved full details on a suitably scaled plan of both hard landscape works must be submitted to and approved in writing by the Local Planning Authority. Subsequently, these works shall be in addition to those shown on the approved plans and shall be carried out and retained as approved. The landscaping details to be submitted shall include:-

a) means of enclosure;
b) existing and proposed finished levels and finished floor levels.
c) details for all external hard surface within the site, including roads, drainage detail and car parking areas.

Reason: The landscaping of this site is required in order to protect and enhance the existing visual character of the area and to reduce the visual and environmental impacts of the development hereby permitted in accordance with Policy DM14 of the Core Strategy and Development Management Policies 2009.
4) All planting, seeding or turfing and soil preparation comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following first use of the development; and any trees or plants which within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. All landscape works shall be carried out in accordance with the guidance contained in British Standards.

Reason: The landscaping of this site is required in order to protect and enhance the existing visual character of the area and to reduce the visual and environmental impacts in accordance with Policy DM14 of the Core Strategy and Development Management Policies 2009.
5) The development hereby permitted shall not be commenced until a detailed surface water drainage design has been submitted to, and approved in writing by, the local planning authority. The final design is to be based on the agreed preliminary design standards set out in the Flood Risk Assessment (April, 2017). The approved final detailed design will be fully implemented and maintained in perpetuity, as agreed by the local planning authority.
The scheme to be submitted shall include:

Details to satisfy standards 1 to 14 of the Sustainable Drainage Systems Non-statutory technical standards for sustainable drainage systems (DEFRA, 2015), including detailed plans of the and calculations showing sufficient disposal, storage and conveyance of surface water (up to and including for the 1in100 year event + a 40% allowance for climate change).

Correspondence with the Bedford Group of Internal Drainage approving the proposed rate and volume of surface water discharge off site and mode/construction of connection.

Overview of proposed construction of the system and any phasing of works.

Details of who the surface water drainage will be managed by and how it will be maintained in perpetuity.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and prevent the increased risk of flooding both on and off site for the lifetime of the development in accordance with Policy CS13 of the Core Strategy and Development Management Policies 2009, the provisions of the NPPF and the Non-statutory technical standards for sustainable drainage systems (DEFRA, 2015).
6) Upon completion of the surface water drainage scheme the following is to be provided for confirmation to the Local Planning Authority:

A verification report detailing that the surface water scheme has been fully implemented s approved.

Final as built drawings of the surface water system, in its entirety.

Confirmation of the management and maintenance arrangements for the surface water drainage scheme, including any split in public and private responsibilities.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system is in line with what has been approved and Written statement - HCWS161, in accordance with Policy CS13 of the Core Strategy and Development Management Policies 2009
7) The development must be delivered in accordance with the terms and conditions of this planning authority's organisational licence (WML-OR24) and with the proposals detailed on plan Figure 3: Impacts of development plan (dated 17.09.18). (And, where applicable in report Ref 201805002).

Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence (WML-OR24) in accordance with Policy CS18 of the Core Strategy and Development Management Policies 2009.
8) All site works (including ground investigations, site preparatory works, ground clearance, etc.) must be carried out in accordance with best practice guidance (GCN Mitigation Principles, as set out in the District Licence WML-OR24) and using reasonable avoidance measures. In addition:

Works which will affect likely newt hibernacula may only be undertaken during the active period for amphibians.

Capture methods must be used at suitable habitat features prior to ground clearance or removal of such features (i.e. hand/destructive/night searches), which may include the use of temporary amphibian fencing, to prevent newts moving onto a development site from adjacent suitable habitat, installed for the period of the development (and removed upon completion of the development).

Reason: In order to adequately mitigate impacts on great crested newts, in accordance with Policy CS18 of the Core Strategy and Development Management Policies 2009.
9) The development hereby approved shall not be carried out other than in accordance with the measures outlined within the document entitled Land off Wood End, Marston Moretaine, Bedfordshire, Heritage Statement (Document 2017/196) dated 12th December 2017 and the drawings associated with this document (Figures 1-13).

Reason: In the interest of features of archaeological significance, in accordance with the provisions of Section 16 of the Framework.
10) The development hereby permitted shall not be brought into use until the following have been constructed in accordance with approved details;
The junction/crossover of the proposed vehicular access with the highway

Passing places along Wood End

Reconstruction and kerbing of the grass island at the Wood End junction fronting the site crossover, including reconstruction of this junction and road markings if required

Visibility splays at the junction of the proposed access

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises, in accordance with Policy DM3 of the Core Strategy and Development Management Policies 2009.
11) The development hereby permitted shall not be brought into use until details of signage within the site showing directional egress to the west have been implemented in accordance with approved details.
Reason: To provide sufficient intervisibility at the junction for vehicles leaving the site, in accordance with Policy DM3 of the Core Strategy and Development Management Policies 2009.
12) Prior to first use of the development hereby permitted, the proposed vehicular access shall be surfaced in bituminous or other similar durable material (not loose aggregate) for a distance of 8.0m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety, in accordance with Policy DM3 of the Core Strategy and Development Management Policies 2009.
13) Any gates provided shall open away from the highway and be set back a distance of at least 5.0 metres from the nearside edge of the carriageway of the adjoining highway.
Reason: To enable vehicles to draw off the highway before the gates are opened, in accordance with Policy DM3 of the Core Strategy and Development Management Policies 2009.
14) The approved cycle parking scheme shall be implemented in accordance with the cycle parking annexes and prior to the development being brought into use, and thereafter retained for this purpose.
Reason: To ensure the provision of adequate cycle parking of the proposed development in the interests of encouraging the use of sustainable modes of transport, in accordance with Policy DM3 of the Core Strategy and Development Management Policies 2009.
