Conditions or Reasons for Planning Application - CB/18/03442/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the visual amenity of the area.

3) Prior to occupation a scheme shall be submitted for approval in writing by the Local Planning Authority indicating the design, material finish and type of gated access to be erected. The gate shall be completed in accordance with the approved scheme before the dwelling is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality. To accord with the requirements of Policy BE8 of the South Bedfordshire Local Plan Review and Section 12 of the NPPF.
5) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building(s) hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building/s in the interests of the amenities of the area.

6) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:
· A Phase 1 Desk Study report documenting the ground conditions of the site with regard to potential contamination;
· A Phase 2 Site Investigation (where shown as necessary the Phase 1 Desk Study);
· A Phase 3 Remediation Scheme (where shown as necessary by the Phase 2 Site Investigation)
All such work shall be undertaken in accordance with BS:10175:2011 or other appropriate guidance issued by the regulatory authorities. The work shall be sufficient to ensure that measures will be taken to mitigate any risks to human health and the wider environment.

Reason: To protect human health and the environment.
7) Prior to any permitted dwelling being occupied a validation report shall be submitted and approved in writing by the Local Planning Authority to demonstrate the effectiveness of any agreed Remediation Strategy . Any such validation shall include responses to any unexpected contamination discovered during works.

Reason: To protect human health and the environment.
8) The proposed driveway shall be constructed and surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 5m into the site, measured from the highway boundary, before the premises are occupied. Arrangement shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway (Section 9, NPPF).
9) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To ensure that off-street parking is retained in the interests of highway safety.(Section 9, NPPF)
10) Before the development is first occupied or brought into use, the parking scheme shown on plan no CURT/21809/PLOTD/PLANFINALA shall be completed and thereafter retained for this purpose.

Reason:To ensure the provision of car parking clear of the highwau (Section 9, NPPF).
11) Any gates provided shall open away from and not encroach upon the public highway.
Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the premises (Section 9, NPPF).
12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, number CURT/21809/PLOTD/PLANFINALA.

Reason: To identify the approved plan/s and to avoid doubt.
