Conditions or Reasons for Planning Application - CB/18/04304/MW
Conditions or Reasons:
1) Planning permission shall extend to the site delineated by a solid red line on plan no. MOO.131(p).D.001 rev A dated 15/10/2018. The development hereby permitted shall be carried out in accordance with the particulars of the development and drawings contained within the planning application as set out below (except as modified by other conditions of this permission):

Reason: To ensure the development is carried out in an acceptable manner, and to provide certainty on what is being authorised by this permission in accordance with advice contained in the National Planning Guidance (Use of Planning Conditions paragraph 022)
2) The development hereby permitted shall be begun no later that the expiration of three years from the date of this permission. Written notification of the date of commencement shall be sent to the Mineral Planning Authority within 7 days of such commencement.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Act 2004 and to enable the Local Planning Authority to monitor other conditions of this permission.
3) Access to the site shall only be by way of the existing access road on to the B658.

Reason: In order to minimise danger, obstruction and inconvenience to the highway in accordance with saved policy GE23 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005
4) No operations or activities authorised by this permission, other than essential maintenance, shall take place outside the hours specified below:

0700 hours to 1800 hours Mondays to Fridays
0700 hours to 1300 hours Saturdays

and no such operations or activities shall take place on Sundays or Public/Bank holidays.

Reason: To minimise disturbance at nearby properties by reason of noise and traffic in accordance with saved policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
5) No development authorised by this permission shall be carried out unless it complies with the provisions of the Scheme for Monitoring and Control of Noise dated 27 August 2009.

Reason: To enable operational noise to be monitored and controlled and to enable mitigation steps to be devised where necessary so as to minimise nuisance to nearby residents by reason of noise in accordance with saved policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
6) No plant, equipment or Heavy Goods Vehicles (HGVs) shall be used on site that utilises tonal reversing alarms.

Reason:To enable the Mineral Planning Authority to exercise control over activities that may cause to nearby residents by reason of noise in accordance with saved policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
7) No plant or machinery shall be used on site unless fitted and operated with efficient noise suppression equipment.

Reason: To enable the Mineral Planning Authority to exercise control over activities that may cause to nearby residents by reason of noise in accordance with saved policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
8) No development authorised by this permission shall be carried out unless it complies with the provisions of the Broom Quarry South Dust Monitoring and Management Scheme dated December 2009.

Reason: To enable dust generated by the development to be monitored and controlled and to enable mitigation steps to be devised where necessary so as to minimise nuisance to nearby residents by reason of dust in accordance with saved policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
9) The development hereby permitted shall cease within three months of 15th April 2026 or the cessation of mineral extraction at Broom Quarry South whichever is the sooner.

Reason: As the facility will largely process mineral sourced from the quarry and its retention after the cessation of mineral extraction would result in a delay in the restoration of the site.
10) All buildings, plant, machinery, structures and foundations shall be removed from the site when they are no longer required for the purposes for which they were erected or installed within 6 months of the 15th April 2026 or the cessation of mineral extraction, whichever is the sooner.The site of the packing plant shall be restored in accordance with the approved restoration for Broom Quarry south.

Reason: To ensure that no plant or machinery is left on site once it is no longer required and to ensure the satisfactory restoration of the site in accordance with policy GE26 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
11) No more than 50 HGVs shall leave the packing plant per day from Monday and Friday each week and no more than 23 on Saturday mornings.

Reason: In the interests of highway safety and the amenity of local residents in accordance with policies GE18 and GE23 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
12) All HGVs leaving the packing plant shall be monitored using the CCTV at the quarry entrance. Records of all HGVs leaving the site shall be maintained and shall be made available for inspection or a summary forwarded to the Mineral Planning Authority within 7 days of a written request.

Reason: To facilitate monitoring of site activities.
13) No external lighting shall to be installed in the packing plant area until details have been submitted to the Mineral Planning Authority and approved in writing. The lighting shall be implemented in accordance with the approved scheme and shall only be illuminated during the approved hours of operation of the plant.

Reason: As the lighting will only be required to enable the effective and safe operation of the packing plant during authorised operating hours and to protect the amenity of the surrounding area in accordance with policy GE18 of the Bedfordshire and Luton Minerals and Waste Local Plan 2005.
14) No plant or structures over 5 metres in height shall be erected unless and until the proposed colour of the plant or structure has been submitted to and approved in writing by the Minerals Planning Authority and shall be implemented in accordance with the approved details.

Reason: In the interests of the amenity of the surrounding area in accordance with saved MWLP policy GE19.
