Conditions or Reasons for Planning Application - CB/18/04344/FULL
Conditions or Reasons:
1) The proposed new detached garage is of a siting, scale, form and design that will result in a prominent and conspicuous form of development which is out of keeping with and detrimental to the character and appearance of the streetscene and setting of the adjoining Potton Conservation Area. The proposal will result in the loss of an important area of open amenity space and conflicts with policies DM3 and DM13 of the Core Strategy and Development Management Policies and Section 12 and16 of the NPPF.
2) The proposed garage conversion and alterations are located within close proximity to a large mature oak tree which is protected by a Tree Preservation Order. The applicant has failed to demonstrate that the proposal will not have a harmful impact on the protected tree at the site as no Arboricultural Impact Assessment (AIA) or Method Statement has been submitted in relation to the required tree information. As such the proposal would be contrary to Policies DM3 and DM14 of the adopted Central Bedfordshire Core Strategy and Development Management Policies Development Plan Document 2009 and Section 15 of the NPPF.
3) The proposed development will result in the intensification of use of a substandard access which makes no provision for adequate driver/driver intervisibility and will lead to conditions of danger and inconvenience to users of the highway and the property. This would be contrary to Policy DM3 of the Core Strategy and Development Management Policies and Section 9 of the NPPF
4) The proposed development will result in the removal of the lateral clearance/verge of the adopted public highway, and remove freely obtainable access to the service margin for services and would obstruct the free flow of pedestrian traffic which may otherwise use the verge, and obstruct service maintenance. Further, the development will create a highway which due to its width and lack of verge does not comply with the authority's guidance and policy and removes publicly maintainable adopted highway. This is contrary to the CBC Design Guide (2014) and the Highways Act 1980.
