Conditions or Reasons for Planning Application - CB/18/04801/FULL
Conditions or Reasons:
1) The proposed residential development would, by reason of its prominent and conspicuous siting on steeply rising land combined with the significant level of engineering and associated works, result in a development that would adversely harm the character and appearance of the site and the surrounding area, including the existing settlement and the landscape character of the Greensand Ridge. The development proposal is therefore not considered to represent a sustainable form of development and is contrary to Policies CS14 (High Quality Development), CS16 (Landscape and Woodland), CS17 (Green Infrastructure), DM3 (High Quality Development), DM4 (Development within and Beyond Settlement Envelopes), DM14 (Landscape and Woodland) and DM16 (Green Infrastructure) of the Central Bedfordshire Core Strategy and Development Management Policies (2009), and the National Planning Policy Framework (2019).
2) The proposed residential development would, by reason of its prominent and conspicuous siting on steeply rising land combined with the significant level of engineering and associated works, result in a development that would be harmful to the setting of the adjacent Grade II Listed Building (11-13 Little Lane) and the Clophill Conservation Area, with no public benefits accruing, contrary to  section 12 of the National Planning Policy Framework and Policies CS15 and DM13 of the Core Strategy and Development Management Policies 2009.
3) Insufficient information has been submitted to enable the Council to properly and fully consider the impact of the development and surroundings in terms of surface water flood risk, contrary to para.163 of the NPPF and the Adopted Central Bedfordshire Sustainable Drainage Guidance.
4) The proposed diversion of Clophill Public Footpath no.4 which it is proposed to re-route along Little Lane would unnecessarily bring footpath users into conflict with road users and vehicles accessing the proposed dwellings. Accordingly the proposal would be harmful to the amenity of footpath users.

The development is therefore contrary to Policies CS14 (High Quality Development) and DM3 (High Quality Development) of the Central Bedfordshire Core Strategy and Development Management Policies (2009), National Planning Policy Guidance, Public Rights of Way Circular 01/09 and chapter 12 of National Planning Policy Framework (2018).
