Conditions or Reasons for Planning Application - CB/19/00157/GPDE
Conditions or Reasons:
1) The subject dwelling and its curtilage resides within the Chilterns Area of Outstanding Natural Beauty which Schedule 1, Part 1 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) defines as Article 2(3) land. Schedule 2, Part 1, Class A, Paragraph A.1(g) of the Order states that the expanded set of permitted development rights for larger rear extensions for dwellings only apply where the dwellinghouse in question and its curtilage is not on Article 2(3) land.

Consequently, the proposal, for a larger rear extension measuring 6m in depth at its deepest point, would be contrary to Schedule 2, Part 1, Class A, Paragraph A.1(g). This means that the proposal would not be permitted development as proposed schemes for extensions, alterations, etc to a dwellinghouse implemented under permitted development rights must comply with ALL of the applicable tolerances of Class A of the Order.

Therefore, this prior notification submission for a larger rear extension is refused and planning permission would be required from the Local Planning Authority for the proposed scheme.
