Conditions or Reasons for Planning Application - CB/19/01947/RM
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those outlined on Plan No. DS 1712.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The planting and landscaping scheme shown on approved Drawing No. SP 02 P1 shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

4) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme [before the use hereby permitted is commenced / before the building(s) is/are occupied] and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details and any surplus lengths of existing dropped kerb re-instated to full kerb

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises and in the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highwa.

6) The required vision splays of 2.4m x 43.0m shown on the approved plan shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed accesses, and to make the accesses safe and convenient for the traffic which is likely to use them.

7) The vehicle access surfacing and parking area surfacing shall be constructed in accordance with the approved plan and thereafter retained as permeable paving unless otherwise agreed in writing by the local planning authority

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.

8) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision on the site shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.

9) The scheme for the secure and covered parking of cycles on the site, and the refuse collection points, as indicated on the approved plan shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport and in the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises

10) No dwelling shall be occupied until a 2.0m wide footway has been constructed along the site frontage to join up with the existing footway to the west of the site and on the north side of Marquis Hill in accordance with details of the approved drawing/or scheme to be submitted to and approved by the Local Planning Authority. Any Statutory Undertakers equipment or street furniture shall be resited to provide an unobstructed footway.

Reason: In the interests of road safety and pedestrian movement.

11) Prior to the construction of the detached storage buildings within the rear gardens of the dwellings hereby approved, detailed elevations and floor plans detailing the dimensions, scale and height of the detached buildings to the rear of the dwellings, demonstrating an acceptable relationship with the neighbouring dwellings shall be submitted to and approved in writing by the Local Planning Authority. The detached buildings shall then be carried out in accordance with the approved plans.

Reason: To ensure that no aspect of the development would result in adverse harm to the amenity and living conditions of neighbouring occupiers

12) The first floor window in the west facing side elevation of plot 1 hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed.

Reason: To safeguard the privacy of occupiers of adjoining properties

13) The site levels will be carried out in exact accordance with the details shown on plan number SP 01 P2.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

14) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
