Conditions or Reasons for Planning Application - CB/19/02090/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The external works hereby permitted to No.3 Chapel Road (Plot 1) shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme before the buildings are occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

4) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building(s) hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building/s in the interests of the amenities of the area.

5) Notwithstanding the provisions of Part 1, Class B and C of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no additions or alterations to the roofs of the Plots 2, 3 and 4 hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To protect the privacy of neighbouring properties

6) Plots 2, 3 and 4 of the development hereby permitted shall be constructed in the materials stated in the Design and Access Statement 01, Page 12, Proposed Materials Palette unless otherwise approved in writing by the Local Planning Authority.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

7) No development above slab level shall take place on plots 2, 3 and 4 until a scheme for protecting the proposed dwellings from noise from rail traffic has been submitted to and approved in writing by the local planning authority. None of the dwellings shall be occupied until such a scheme has been implemented in accordance with the approved details, and shown to be effective, and it shall be retained in accordance with those details thereafter.

Reason: To protect the amenity of future occupiers of the development
8) The development hereby permitted shall not begin until a scheme to deal with contamination of land/ground gas/controlled waters has been submitted to and approved in writing by the local planning authority. The scheme shall include all of the following measures, unless the local planning authority dispenses with any such requirement specifically in writing:
1. A Phase I site investigation report carried out by a competent person to include a desk study, site walkover, the production of a site conceptual model and a human health and environmental risk assessment, undertaken in accordance with BS 10175: 2011 Investigation of Potentially Contaminated Sites Code of Practice.
2. A Phase II intrusive investigation report detailing all investigative works and sampling on site, together with the results of the analysis, undertaken in accordance with BS 10175:2011 Investigation of Potentially Contaminated Sites Code of Practice. The report shall include a detailed quantitative human health and environmental risk assessment.
3. A remediation scheme detailing how the remediation will be undertaken, what methods will be used and what is to be achieved. A clear end point of the remediation shall be stated, and how this will be validated. Any ongoing monitoring shall also be determined.
4. If during the works contamination is encountered which has not previously been identified, then the additional contamination shall be fully assessed in an appropriate remediation scheme which shall be submitted to and approved in writing by the local planning authority.
5. A validation report detailing the proposed remediation works and quality assurance certificates to show that the works have been carried out in full accordance with the approved methodology shall be submitted prior to first occupation of the development. Details of any post-remedial sampling and analysis to demonstrate that the site has achieved the required clean-up criteria shall be included, together with the necessary documentation detailing what waste materials have been removed from the site.

Reason: To minimise and prevent pollution of the land and the water environment and in accordance with national planning policy guidance set out in section 11 of the National Planning Policy Framework, and in order to protect human health and the environment

This planning condition is required to be pre-commencement in order to ensure that any pollutants within the existing buildings to be demolished or in the surrounding land is identified and adequately removed prior to the construction of the proposed dwellings.

9) No development shall take place, including any works of demolition, until a Construction Traffic Management Plan, associated with the development of the site, has been submitted and approved in writing by the Local Planning Authority which will include information on:
(A) The parking of vehicles within the site
(B) Loading and unloading of plant and materials used in the development within the site
(C) Storage of plant and materials used in the development clear of the public highway
(D) The erection and maintenance of security hoarding / scaffolding affecting the highway if required.
(E) Wheel washing facilities
(F) Measures on site to control the deposition of dirt / mud on surrounding roads during the development.
(G) Footpath/footway/cycleway or road closures needed during the development period
(H) Traffic management needed during the development period.
(I) Times, routes and means of access and egress for construction traffic and delivery vehicles (including the import of materials and the removal of waste from the site) during the development of the site.

The approved Construction Management Plan associated with the development of the site shall be adhered to throughout the development process.

REASON:
In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety.

This planning condition is required to be pre-commencement in order to ensure the construction and demolition process is carried out to minimise the impact on Chapel Road.
10) The bungalows hereby permitted shall not be occupied until the widened junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details.

Reason
In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
11) Before the access is brought into use an area of land across the whole of the site frontage measuring at least 1.8m from and parallel to the nearside edge of the adjacent road carriageway shall be provided and thereafter be kept free of all obstruction to visibility exceeding a height of 600mm above the adjoining carriageway level.

Reason
To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
12) The proposed vehicular access shall be surfaced in bituminous or other similar durable material (not loose aggregate) as may be approved in writing by the Local Planning Authority before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason
To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.
13) Prior to occupation of Plots 2, 3 and 4 a landscaping scheme shall be submitted and approved in writing by the Local Planning Authority to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

14) Within three months of the demolition of the outbuildings and garages hereby approved, all resultant detritus shall be completely removed from the site.

Reason: In order to provide an adequate level of amenity for neighbouring occupiers and improve the appearance of the site.
15) No development shall take place until details of the existing and final ground and slab levels of the buildings hereby approved have been submitted to and approved in writing by the Local Planning Authority. Such details shall include sections through both the site and the adjoining properties (No.17a/19a Windmill Road). Thereafter the site shall be developed in full accordance with the approved details.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

This planning condition is required to be pre-commencement in order to ensure that an acceptable relationship between the proposed and existing dwellings in terms of height is achieved prior to construction.
16) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 03-03-010 Rev B, 03-02-003 Rev C, 03-03-011 Rev B, 03-03-010 Rev B, 03-02-002, 03-02-001, 03-03-012, 03-03-001, 03-03-011, 03-03-001 and 19094-TOPO

Reason: To identify the approved plan/s and to avoid doubt.
