Conditions or Reasons for Planning Application - CB/19/02286/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development shall not be brought into use until the junction of the proposed vehicular access with the highway at Drove Road has been constructed in accordance with the approved details and the widened junction of the existing vehicle access with the highway at Banks Close has been constructed in accordance with the approved details.

Reason

In order to minimise danger, obstruction and inconvenience to users of the highway and the premises, pursuant to policy DM3 of the adopted Core Strategy (2009) and Section 9 of the NPPF (2019
3) Visibility splays shall be provided at the junction of the vehicular access with the public highway at Drove Road before the development is brought into use in accordance with the approved plan. The splays shall extend to the limits of the site's highway frontage from a point on the centre line of the access measured 2.4m back from the road channel. The required vision splays shall for the duration of the development remain free of any obstruction to visibility.

Reason

To provide adequate visibility between the existing highway and the proposed access, and to make the acces safe and convenient for the traffic which is likely to use it, pursuant to policy DM3 of the adopted Core Strategy (2009) and Section 9 of the NPPF (2019)
4) The proposed vehicular access shall be surfaced in bituminous or other similar durable material (not loose aggregate) as may be approved in writing by the Local Planning Authority for a distance of 5.0m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason

To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety, pursuant to policy DM3 of the adopted Core Strategy (2009) and Section 9 of the NPPF (2019)
5) No gates shall be erected at the vehicular accesses at Drove Road and Banks Road.

Reason

To ensure adequate pedestrian and highway safety in the area and for the avoidance of doub, pursuant to policy DM3 of the adopted Core Strategy (2009) and Section 9 of the NPPF (2019)
6) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015, or any amendments thereto, the parking provision on the site shall not be used for any purpose other than as parking provision, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason

To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users, pursuant to policy DM3 of the adopted Core Strategy (2009) and Section 9 of the NPPF (2019)
7) A scheme for the secure and covered parking of cycles on the site in accordance with the councils cycle parking annexes shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason

To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport, pursuant to Section 9 of the NPPF (2019)
8) A refuse collection point located at the site frontage and outside of the public highway and any visibility splays shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.

Reason

In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises, pursuant to Section 9 of the NPPF (2019)
9) No more than four children or people in care shall reside at the home hereby approved at any one time, unless otherwise agreed in writing with the Local Planning Authority.

Reason

In the interest of minimising the general noise and disturbance generated by the proposed use in the interest of the residential amenity of the area, pursuant to policy DM3 of the adopted Core Strategy and Development Management Policies (2009)
10) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC01; CBC02; CBC03

Reason: To identify the approved plan/s and to avoid doubt.
