Conditions or Reasons for Planning Application - CB/19/02687/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL01 and PL02.
Reason: To identify the approved plan/s and to avoid doubt.
3) Before the access/garages is first brought into use a triangular vision splay shall be provided on the north side of the new access and shall measure 1.8m along the fence, wall, hedge or other means of definition of the front boundary of the site (annotated landscape area), and 1.8m measured into the site at right angles to the same line along the side of the new access drive. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason
To provide adequate visibility between the existing ROW and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
4) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, cycle parking provision and storage pertaining to the residential use unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason
To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.
5) The access between the garages shall have a minimum width of 4.7m

Reason: In the interest of road safety and for the avoidance of doubt.
6)
'A written scheme of archaeological investigation that includes the provision for post excavation analysis and publication shall be submitted to and approved in writing by the Local Planning Authority before any footings are commenced upon the site. The development hereby approved shall only be implemented in full accordance with the approved archaeological scheme.'

Reason: This condition is pre-commencement as a failure to secure appropriate archaeological investigation in advance of development would be contrary to paragraph 199 of the National Planning Policy Framework (NPPF) that requires developers to record and advance of understanding of the significance of any heritage assets to be lost (wholly or in part) as a consequence of the development.
7) Details of low level lighting to be provided alongside the public footpath to the immediate east of the garages shall be submitted to and approved in writing by the Local Planning Authority. This lighting shall be implemented within one month of the date of the garages being completed and the approved lighting shall be maintained at all times.

Reason: To light the footpath in the interest of safeguarding the amenities of users of the footpath.
