Conditions or Reasons for Planning Application - CB/19/03602/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials as detailed in the submitted application form.

Reason: To safeguard the appearance of the completed development in the interests of the visual amenities of the locality.(Section 12, NPPF)
3) All existing onsite buildings and steel containers shall be removed from the site prior to occupation of the dwelling.

Reason: In the interests of the visual amenities of the area.(Section 12, NPPF)
4) The access shall be no less than 4.8m wide for the first 8.0m into the site measured from the nearside kerbline

Reason: For the avoidance of doubt and to allow for the two way flow of vehicles at the access and avoid obstruction of the free flow of traffic along the carriageway. (Section 9 NPPF)
5) Visibility splays shall be provided at the junction of the access with the public highway before the development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43.0m measured from the centre line of the proposed access along the line of the channel of the public highway. The required vision splays shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it. (Section 9 NPPF)
6) The proposed vehicular access shall be surfaced in durable material (not loose aggregate) as shown on the approved block plan 05A and external works details for a distance of 6m into the site, measured from the highway boundary, before the premises are occupied. Surface water drainage from the site shall be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.(Section 9 NPPF)
7) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres from the nearside edge of the carriageway of the adjoining highway. The gates shall remain free of obstruction to opening to all vehicles using the site and the turning area

Reason: To enable vehicles to draw off the highway before the gates are opened and for vehicles to turn within the site and leave in forward gear and not reverse into the flow of traffic using the public highway. (Section 9 NPPF)
8) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision and turning area free of obstruction on the site shall not be used for any purpose, other than as parking provision and turning area pertaining to the residential use only unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users and to allow vehicles to turn and leave the site in forward gear and not reverse into the flow of traffic using the public highway. (Section 9 NPPF).
9) The refuse collection point indicated on the approved plan shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.

Reason: In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Section 9 NPPF).
10) The final ground and slab levels of the dwelling shall be as shown on the approved Block Plan drawing and Site Section drawing unless otherwise agreed in writing by the Local Planning Authority.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

11) No equipment, machinery or materials shall be brought on to the site for the purposes of development until tree protection has been installed in accordance with the detail provided in the Tree Survey Report by RGS and all development carried out having regard to the report.

Reason: To protect the trees so enclosed in accordance with Section 8 of BS 5837 of 2012 or as may be subsequently amended.

12) The landscaping scheme including all hard and soft landscaping as shown on approved block plan 05A and the scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping. (Sections 12 & 15, NPPF)
13) Notwithstanding the provisions of Part 1 Class A, B and E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extension, buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the visual amenity of the area.(Section 12, NPPF)
14) In the event that contamination is found at any time when carrying out the approved development, it shall be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment shall then be undertaken by a competent person, in accordance with 'Model Procedures for the Management of Land Contamination, CLR 11'. A written report of the findings should be forwarded for approval to the Local Planning Authority. Following completion of remedial measures a verification report shall be prepared that demonstrates the effectiveness of the remediation carried out. No part of the development should be occupied until all remedial and validation works are approved in writing.

Reason: To protect human health and to ensure that no future investigation is required under Part 2A of the Environmental Protection Act 1990.
15) All ecological measures and/or works shall be carried out in accordance with the details contained in the May 2019 Preliminary Ecological Appraisal and Preliminary Roost Assessment.

Reason: To ensure all impacts from development are taken into account and mitigated in accordance with policy CS18 of  the Core Strategy and Development Management Policies (2009) & (Section 15, NPPF)
16) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
17) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
