Conditions or Reasons for Planning Application - CB/19/04132/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the granting of planning permission, no enclosure/surfacing/structure on the land shall take place until such time as the highway rights over the land have been formally extinguished by a formal Stopping Up Order made under Section 247 of the Town and Country Planning Act 1980 or by the application to the Magistrates Court under Section 117 of the Highways Act 1980, after which, the development shall not be brought into use until the junction of the proposed vehicular access with the highway has been constructed in accordance with details to be submitted to and approved in writing by the Planning Authority and the access surfaced in accordance with the approved plan.

Reason: For the avoidance of doubt, to avoid encroachment/obstruction of the public highway in order to minimise danger, obstruction and inconvenience to users of the highway and the premises and to avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.

3) Within 6 months of the date of this planning permission the replacement of the gravel area with grass verge as shown on drawing no. 16124(D) 514 shall be implemented in accordance with the details shown on that approved plan.

Reason: For the avoidance of doubt and to minimise obstruction and inconvenience to users of the public highway.

4) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 16124 (D) 512, 16124 (D) 514, 16124 (D) 515.

Reason: To identify the approved plans and to avoid doubt.
