Conditions or Reasons for Planning Application - CB/19/04233/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to development, a Tree Protection Plan and an Arboricultural Method Statement, based on the Arboricultural Impact Assessment Report and Tree Constraints Drawing, as prepared by Landmark Trees, dated February 2020 (Ref. MEA/150KW/AIA/01) shall be submitted to the Local Planning Authority for approval. The approved Tree Protection Plan and Arboricultural Method Statement shall then be implemented in strict accordance with the recommended sequence of operations, with all tree protection fencing remaining securely in position throughout the entire course of development works.

Reason
To ensure that the retained trees within the rear garden are protected from all development activity works, by creating the necessary construction exclusion zones, and adopting working practices undertaken in accordance with good arboricultural practice, so as to ensure the good health, stability and amenity value of the trees. (Sections 12 & 15, NPPF)
3) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

4) Notwithstanding the details shown, no part of the building structure including foundations, eaves, soffits or guttering shall be erected or installed in, under or overhanging the shared boundary No.17 Oakway used to service the extension.

Reason
To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally to a high standard in the interests of the visual amenities of the locality.

5) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no windows shall be inserted into the east side flank elevation of the proposed extension, without the grant of further specific planning permission from the Local Planning Authority.

Reason: To protect the residential amenity of neighbouring property. (Section 12, NPPF)
6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers OAY_PL_EX_01B, OAY_PL_EX_03B, OAY_PL_PR_00B, OAY_PL_EX_02B, OAY_PL_PR_04G, OAY_PL_EX_04C, OAY_PL_PR_01G, OAY_PL_EX_00B, OAY_PL_EX_05A, OAY_PL_PR_06E, OAY_PL_PR_05E, OAY_PL_PR_02E, OAY_PL_PR_07E and OAY_PL_PR_03E.


Reason: To identify the approved plans and to avoid doubt.
