Conditions or Reasons for Planning Application - CB/20/00189/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to any use hereby commencing, a scheme containing full details of arrangements for internal air extraction, odour control, discharge to atmosphere from cooking operations, including any external ducting and flues, shall be submitted to and approved in writing by the local planning authority along with details of any required noise control. The works detailed in the approved scheme shall be installed in their entirety before the use hereby permitted is commenced. The equipment shall thereafter be maintained in accordance with the manufacturer's instructions and operated at all times when cooking is being carried out unless otherwise agreed beforehand in writing with the local planning authority.

Reason: To safeguard the residential amenity of the occupiers of neighbouring properties.

3) The retail use hereby permitted shall only be operated and shall only be open to the public between the following hours. This would allow the staff to clean and prepare inside the premises outside those times:

Monday: 9am 6pm
Tuesday: 9am 6pm
Wednesday: 9am 8pm
Thursday: 9am 6pm
Friday: 9am 8pm
Saturday: 9am 8pm
Sunday: 10am 5pm
(bank holiday timings 10am-4pm)

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

4) The kitchen window in the south east elevation shall be

obscure-glazed, and
non-opening unless the parts of the window which can be opened are more than 1.7 metres above the floor of the room in which the window is installed.

No further windows or other openings shall be formed in the elevation.

Reason: To safeguard the amenities of the neighbouring occupiers
5) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 01A(Location Plan); 20 (Proposed plans & elevations); 22A(Proposed site plan); 10 (Existing plans and elevations); 02A (Existing Site Plan)

Reason: To identify the approved plan/s and to avoid doubt.
