Conditions or Reasons for Planning Application - CB/20/01037/TDM
Conditions or Reasons:
1) The proposed siting of the development will lead to an obstruction within the public highway(footway) and would lead to a narrowing of the available footway worsened if the cabinet doors are open for maintenance resulting in insufficient footway width for the passing and repassing of pedestrians, some of which may be vulnerable, which will lead to conditions of danger and inconvenience to users of the highway. The proposed development is not therefore a high standard of design and layout and conflicts with policies DM3, CS4 and CS14 of the Core Strategy and Development Management Planning Document dated 2009, Section 9 of the National Planning Policy Framework (2019) and chapter 11 (para 11.4) of the Highway Construction Standards & Specifications Guidance Central Bedfordshire Council dated July 2019.
2) The proposed streetpole and equipment cabinets, by reason of their height, form and location with limited screening from trees or landscaping will appear unduly prominent and visually intrusive. The mast will appear visually dominant in the streetscene and will be materially out of scale with the local character, also resulting in an unacceptable impact on the visual amenities of neighbouring residential occupiers. It is considered that the applicant has not adequately demonstrated that other less visually damaging options cannot be achieved. The proposal is therefore contrary to policies CS14 and DM3 of the Core Strategy and Development Management Policies (2009) and sections 10 and 12 of the National Planning Policy Framework (2019)
