Conditions or Reasons:
1) The application site is located within a wider commercial site which might present contamination and noise risks. A biomass boiler is believed to be serving at least one of the commercial premises with storage and deposit of timber and waste to serve the biomass boiler immediately adjacent to the residential flats. No impact assessments have been undertaken or submitted to demonstrate that noise, contamination and air quality impacts in such close proximity to the residential flats can be suitably controlled or mitigated to ensure a reasonable living environment for occupiers of the dwellings. The development would therefore conflict with Policy DM3 of the CS&DMS (2009) and Chapter 15 of the NPPF (2019)
2) The development lies outside of the settlement boundary for Aspley Guise and is not in a sustainable location with regard to services and facilities and public transport. The wider site is commercial, and the development would not enhance its immediate setting as required by paragraph 79 of Chapter 5 of the NPPF (2019). In addition, the development fails to comply with national and local design guidance with regards to providing adequate natural light in all habitable rooms and providing adequate private amenity space. The development conflicts with policy DM3 of the CS&DMP (2009) and with the residential amenity aims of the NPPF (2019); the National Design Guide (2020) and the Central Bedfordshire Design Guide (March 2014).
