Conditions or Reasons for Planning Application - CB/20/01734/FULL

Conditions or Reasons:

1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

2) Prior to the first occupation of the building, the cycle parking as shown on approved drawing ref: 20.32.01A shall be provided and shall be retained for use by the occupiers/ customers of Unit 8 thereafter.

Reason

To ensure sustianable methods of transport can be used to access the application site (Section 9, NPPF).

3) Noise resulting from the use of the plant, machinery or equipment at the commercial unit shall not exceed a level of 5dBA below the existing background level (or 10dBA below if there is a tonal quality) when measured according to BS4142:1997, at a point one metre external to the nearest noise sensitive building.

Reason: To minimise the potential for noise nuisance to local residents (policy DM3, Core Strategy 2009)

4) The change of use of unit 8 to Class D2 hereby approved shall not be open for business between the hours of 23.00 and 07.00 daily, unless otherwise agreed in writing by the Local Planning Authority.

Reason: To safeguard the amenities which the occupiers of neighbouring properties might reasonably expect to enjoy (policy DM3, Core Strategy 2009)

5) Deliveries by commercial vehicles to the commercial unit shall be restricted to between the hours of 06.00 and 21.00hrs Monday to Friday, 06.00 and 20.00hrs on Saturdays, and 09.00 and 17.00hrs on Sundays and Bank Holidays. No deliveries by Heavy Goods Vehicles (i.e. those exceeding 3.5t) shall be undertaken before 07.30hrs on any day.

Reason: To safeguard the amenities which the occupiers of neighbouring properties might reasonably expect to enjoy.

6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 20.32.01A; 20.32.OSmap2

Reason: To identify the approved plan/s and to avoid doubt.
