Conditions or Reasons for Planning Application - SB/01/00016
Conditions or Reasons:
1) 1. The proposed use of the premises as a hot food takeaway would be likely to result in increased noise, disturbance, fear of crime and general activity thereby detrimental to the residential amenities of neighbouring and nearby occupiers. The proposal is therefore contrary to Policy BE11 of the South Bedfordshire Local Plan, and Policies BE8 and SH4 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes). 2. The proposal is contrary to Policy SH5 of the South Bedfordshire Local Plan and Policy SH4 of the South Bedfordshire Local Plan First Review Deposit which seek to resist proposals involving the loss of local shopping facilities outside the town centres unless the use fulfils a local community need by extending the range of facilities or services in that area or includes other uses combined with a retail facility as an ancillary use, or residential. Since a Planning Authority may not distinguish between types of food within Class A3 and a Class A3 takeaway is already represented in the parade the proposal could not therefore be said to extend the range of facilities or services in the area. For this reason and because the proposal would lose an A1 use and likely cause a loss of residential amenity it is contrary to the above policies and to Policy SD1 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) which seeks to promote sustainable forms of development.
