Conditions or Reasons for Planning Application - CB/20/01946/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
3) The premises shall only be open for customers between 0800 hours and 1900 hours Monday - Friday and 0800 hours and 1600 hours Saturdays, and at no time on Sundays, Bank or Public Holidays, without the prior agreement in writing of the Local Planning Authority.

Reason: To ensure the opening hours of the proposed extensions match that of the existing building and to protect the amenity of neighbouring occupiers (policy DM3, Core Strategy).
4) All plant, machinery and equipment (including fans, ducting and external openings) to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to prevent the transmission of noise and vibration into any premises either attached to, or in the vicinity of the premises to which the application refers.
Reason: To protect the amenity of neighbouring occupiers (policy DM3, NPPF)
5) The parking spaces numbered 1 to 14 shown on the approved plan shall be demarcated and implemented prior to the development hereby approved being brought into use. Thereafter, the parking provision shall remain as approved unless otherwise agreed in writing by the local planning authority.
Reason: For the avoidance of doubt and to provide adequate parking provision within the site rather than as hoc parking that will reduce the required parking provision (Section 9, NPPF).
6) The vehicular access shall be surfaced in bituminous or other similar durable material (not loose aggregate) for a distance of 5.0m into the site, measured from the highway boundary, before the development is brought into use. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
Reason: To avoid the carriage of extraneous material/loose aggregate or surface water from the site into the highway so as to safeguard the interest of highway safety. Loose aggregate within the public highway causes a slipping hazard and injury to persons and damage to vehicles (Section 9, NPPF).
7) Notwithstanding the details shown on the approved plans, the existing access shall be no greater than 5.0 metres wide with the surplus lengths of existing access closed and re-instated in a manner to the Local Planning Authority's written approval and constructed in accordance with the approved details prior to the development being brought into use.
Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway, to avoid the crossover being used as a parking bay as it is surplus to requirements due to the parking layout (Section 9, NPPF)
8) The available turning area for service/delivery sized vehicles at the front of parking bay 3 and the forecourt area fronting parking bays 5 to 11, shall remain free from obstruction for the purposes of vehicles turning for the perpetuity of the development.
Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway (Section 9, NPPF).
9) The cycle parking as shown on approved drawing 1280_P-03 (issue P03) shall be fully implemented before the development is first brought into use and thereafter retained for this purpose.
Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport (Section 9, NPPF)
10) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building and in accordance with section 4.7 of the submitted Design & Access Statement (ACD Projects Ltd, 01/06/20) and section 7 of the submitted application form.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.
(Section 12, NPPF)
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 1280_P_02; 1280_P021; 1280_P_10; 1280_P_12; 1280_P_11; 1280_P_020; 1280_P_01; 1280_P_03 (issue P03); Design and Access Statement (ACD Projects Ltd, 01/06/20).

Reason: To identify the approved plan/s and to avoid doubt.
