Conditions or Reasons for Planning Application - CB/20/02475/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building at 22 Hinksley Road, and as described in Q7 of the submitted application form and as shown on approved drawing ref: 03-05-101/ rev B, unless otherwise agreed in writing with the Local Planning Authority.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
4) The boundary treatment to be erected shall be completed in accordance with approved drawing ref: 03-03-102/ rev B before the building is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) Notwithstanding the provisions of Part 1, Classes A and AA of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building in the interests of the amenities of the area, to protect the residential amenities of adjoining occupiers and to ensure that adequate private amenity space is retained for the proposed dwelling (Section 12, NPPF)
6) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the visual amenity of the area and to ensure that adequate private amenity space is retained for the proposed dwellinghouse. (Section 12, NPPF)
7) The width of the new access from the public highway shall be 3.5m wide. Within the site,the parking space / driveway shall measure at least 3.5 x 5.0m in accordance with Central Bedfordshire's design guide.

Reason: To ensure adequate access and satisfactory parking of vehicles outside highway limits (Section 9, NPPF).
8) A suitable bound material (e.g. tarmac or block paviours) shall be used to form the hardstanding / driveway / parking area within the site.
Reason: To avoid the carriage of mud or other extraneous material from the site so as to safeguard the interest of highway safety (Section 9, NPPF).
9) Details of the arrangements to be made for surface water drainage from the site to soakaway within the site so that it does not discharge into the highway or into the main drainage system shall be submitted to and approved in writing by the local planning authority. The development shall be implemented in accordance with the approved details prior to the first occupation of the approved dwellinghouse and the approved scheme shall be retained thereafter.
Reason: To avoid surface water from the site discharging into the highway so as to safeguard the interest of highway safety and reduce the risk of flooding.
10) Before the access is first brought into use, a triangular vision splay shall be provided of 2.0m (X) x 2.8m (Y), where X represents the position of a driver, measured into and along the centreline of the parking space / driveway from the back of the footway; and Y represents the distance that a driver who is about to exit from the parking space / driveway can see to their left and right along the footway, measured along the back of the footway and taken from the point where this line intersects the centreline of the parking space / driveway (Figure 4.2 of the CBC Highway Construction Standards & Specifications Guidance (July 2019)). The splay shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.
Reason: To provide adequate inter-visibility between drivers and pedestrians using the footway.
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 03-02-101; 03-03-102/ rev B (Site plan-existing and proposed and roof plan); 03-03-101/ rev B; 03-05-101/ rev B.

Reason: To identify the approved plan/s and to avoid doubt.
