Conditions or Reasons for Planning Application - CB/20/02638/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those detailed on plan No. 200 Rev B and PL600 Rev 01.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The improvements to the junction between the proposed development and Church Street shall be carried out in exact accordance with plan Nos. 1005:01, 1005:04, 1005:02 and 1005:03. No dwelling shall be occupied until that junction has been constructed in accordance with the approved details

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the proposed estate road.

4) The improvements to the junction between the proposed development and St Peters Road shall be carried out in exact accordance with plan Nos. 1005:01, 1005:04, 1005:02 and 1005:03. No dwelling shall be occupied until that junction has been constructed in accordance with the approved details

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the proposed estate road.

5) Before an access onto estate road is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed accesses, and to make the accesses safe and convenient for the traffic which is likely to use them.

6) Before the premises are occupied all on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises.

7) The development shall not be occupied or brought into use until the parking scheme shown on Drawing No. 003 Rev A has been completed. The scheme shall thereafter be retained for this purpose.

Reason: To ensure provision for car parking clear of the highway.

8) The development hereby approved shall be carried out in full accordance with the methods of noise mitigation outlined within the document titled External Building Fabric Assessment, reference 10101.RP01.EBF.2 dated 14/07/2020, and within the document titled Plant Noise Impact Assessment, reference 10101.RP02.PNA.0 dated 02/09/2020. No dwellings shall be occupied until the scheme providing protection for those dwellings has been implemented in accordance with the approved details and has been demonstrated to achieve the required noise levels to the satisfaction of the Local Planning Authority. The approved scheme shall be retained in accordance with those details thereafter.

Reason: To protect the residential amenity of any future occupants

9) The proposed on site lighting shall be carried out in full accordance with plan No. LL1187-001, and shall be retained in accordance with the approved plans hereby after.

Reason: To protect the amenity of surrounding residents.

10) Prior to the construction of vehicular parking areas associated with the approved dwellinghouses, a scheme for the charging of electric vehicles shall be submitted to and approved in writing by the Local Planning Authority. Subsequently, the development shall be completed in accordance with these approved details.

Reason: To assist with the transition to low-emission vehicles in line with paragraph 110 of the National Planning Policy Framework (2019).
11) All ecological measures and/or works shall be carried out in accordance with the details contained in the May 2020 Ecological Enhancement Strategy.

Reason: To ensure existing or new habitats affected by development are managed effectively over an established period.

12) The surface water drainage details associated with the proposed development shall be carried out in exact accordance with the information and details outlined within the SUDS Management and Maintainance Plan (FCL/354/004 Rev A dated 25/09/2020), the Drainage Specification (FCL/354/002 Rev C dated 25/08/2020), and plan Nos. FCL/354/006 Rev A, FCL/354/005 Rev A, FCL/354/008 Rev A and FCL/354/007 Rev A.

Reason: To ensure the approved system will function to a satisfactory minimumstandard of operation and maintenance and prevent the increased risk of flooding both on and off site, and to ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161.

13) The planting and landscaping scheme shown on approved Drawing 7264.ASP.PP.1.0 Rev A shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

14) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 002, 003 Rev A, 100 Rev A, CBC-001, LL1187-001, 7264.ASP.PP.1.0 Rev A, 201 Rev A, 103 Rev A, 102 Rev A, 300 Rev A, 104 Rev A, 202 Rev B, 1005:04, 1005:03, 1005:02, 1005:01, 200 Rev B, 101 and PL600 Rev 01.

Reason: To identify the approved plan/s and to avoid doubt.
