Conditions or Reasons for Planning Application - CB/20/02795/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

3) No development shall take place until details of the existing and final ground and slab levels of the site hereby approved have been submitted to and approved in writing by the Local Planning Authority. Such details shall include sections through both the site and the adjoining properties, the location of which shall first be agreed in writing with the Local Planning Authority. Thereafter the site shall be developed in full accordance with the approved details.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

4) Details of the storage and disposal of manure and the location of any manure storage area shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. Manure shall be stored and disposed of strictly in accordance with the approved details.

Reason: In the interests of neighbouring amenity and to prevent pollution of the environment.
5) Prior to development, all imported soil deposits located around the boundary hedgerows shall be reinstated back to their original soil levels, to a distance into the site that is equivalent to at least the existing height of the hedge.

REASON
To remove harmful build up of soil around the hedgerow root systems, which is presently causing root asphyxiation, in order to improve the health of the hedgerow, and maintain its landscape and screening value.
6) Prior to development, a landscape planting scheme, planting and maintenance specification shall be submitted to the Local Planning Authority for approval, showing the provision for the planting of additional native trees, shrubs and hedging, to be used to supplement and/or gap-up the existing plants within the hedgerow. The approved planting scheme shall then be implemented in the first planting season (November to March) following completion of development, and shall be maintained for a period of 5 years thereafter, with any losses replaced in accordance with the approved planting plan and planting specification.

REASON
To ensure the satisfactory provision, aftercare and establishment of supplementary hedgerow planting in the interests of visual amenity, landscape screening and biodiversity.
7) The turning facility shown on Drawing No.19.051.1010 Revision G [Site Plan], opposite No.19 Bower Lane (being the northernmost of the four recently completed dwellings), shall be constructed prior to the development being brought into use and retained thereafter for the purpose of allowing vehicles associated with the paddock to turn and park. The facility shall be hard-surfaced in order that it can be used for its intended purpose in all weathers.
Reason
In the interest of safety of all users of the private driveway and the public highway.
8) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme [before the use hereby permitted is commenced] and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

9) Vehicular access to the development hereby approved shall be gained via the shared private driveway serving Nos.11, 15, 17 & 19 Bower Lane only. Vehicular access shall not be made via the track adjacent to No.57 Bower Lane.
Reason
In the interest of highway safety.
10) The development hereby permitted shall be limited to the private recreational use of the stable and paddock and shall not be used for commercial use, a livery use or any other purpose.
Reason
To limit the volume of vehicle trips generated by the paddock and using the shared private driveway, in the interest of the safety of all users of the private driveway and the public highway and to prevent the stables from being used for commercial purposes to the detriment of the locality.
11) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 19 051 1010 Rev G, 19 051 1000 Rev D and 19 051 200.

Reason: To identify the approved plan/s and to avoid doubt.
