Conditions or Reasons for Planning Application - CB/20/03209/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The first floor window serving an ensuite bathroom in the east facing side elevation of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed.

Reason: To safeguard the privacy of occupiers of adjoining properties

4) Before the new dwelling is occupied all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by
the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the
highway or into the main drainage system.

Reason
To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding
and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits.
5) Before the joint access is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the
back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the highway into the site along the centre
line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility
exceeding a height of 600mm above the adjoining footway level.

Reason
To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
6) Prior to occupation of the new dwelling a scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and
type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme before the dwelling is occupied and be
thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual
amenities of the locality.

8) No equipment, machinery or materials shall be brought on to the site for the purposes of development until the ground protection measures for the protection of the retained Oak Tree, have been erected in the positions shown on the submitted plan 1867/6E. The approved ground protection shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area protected in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made.

Reason: To protect the trees in accordance with BS 5837 of 2012 or as may be subsequently amended.

9) The new dwelling shall not be occupied until the widened junction has been constructed in accordance with the details submitted in plan No. 1867/6e.

Reason
In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
10) Prior to commencement of the development, plans of the proposed foundations for the new dwelling shall be submitted to the Local Planning Authority for approval. The foundations shall then be built in accordance with the approved plans.

All new service lines and soakaways are to avoid the root protection area of the Oak tree identified.

Reason: To ensure the protection of the Oak Tree in No.10 Ampthill Road's garden, and to avoid unnecessary damage to it's root systems.

11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 1867/6e, 1867/Bd, 1867/7e & 1867/3B.

Reason: To identify the approved plans and to avoid doubt.
