Conditions or Reasons for Planning Application - CB/20/03231/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers A01/001/D, A01/060/D, A01/061/D, A0/001/C and A0/ 050/C

Reason: To identify the approved plan/s and to avoid doubt.
4) Before the proposed boundary fence is constructed the existing access taken from House Lane shall be closed in a manner to the Local Planning Authority's written approval and constructed in accordance with the approved details. The area of highway verge between the proposed fence line and utilities company box shall be re-instated as verge. (See Notes to the Applicant)
Reason: In the interest of road safety and to reduce the number of points at which traffic will enterand leave the public highway and to avoid the crossover being used as an informal onstreet parking bay
5) Notwithstanding the granting of planning permission, no enclosure ofthe land/public highway shall take place until such time as the highwayrights over the land have been formally extinguished by a formal Stopping Up Order made under Section 247 of the Town and Country Planning Act 1980 or by the application to the Magistrates Court underSection 117 of the Highways Act 1980, after which, the fenced or other means of enclosure of the land shall be implemented in accordance with the approved drawing no. A-01-001D, including an inwards opening pedestrian gate and the hedge/vegetative growth from the property overhanging into the public highway removed.(see NOTES TO APPLICANT)
Reason: To provide adequate visibility between the existing highway and the access for no. 10, and to make the access safe and convenient for the traffic which is likely to use it and for the avoidance of doubt
6) The pedestrian gate as indicated on the approved plan shall remain as a pedestrian use gate only unless otherwise agreed in writing by the local planning authority.
Reason: For the avoidance of doubt and to alleviate vehicular traffic from entering the site without a constructed junction to avoid damage to the public highway which will cause a hazard to users of the highway.
