| Conditions or Reasons: | 1)
The development hereby permitted shall begin not later than three years from the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |

The development shall be carried out strictly in accordance with either an Ecological Enhancement Strategy that is approved pursuant to Conditions 15 and 17 of planning permission CB/18/04165/OUT or a separate Ecological Enhancement Strategy which is to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and shall contain the following information:
a) An ecological assessment of the site prior to any development taking place, b) Purpose and conservation objectives for the proposed development informed by a review of the existing ecological assessment. b) Review of site potential and constraints. c) Detailed design(s) and/or working method(s) to achieve stated objectives. d) Extent and location/area of proposed works on appropriate scale plans. e) Type and source of materials to be used where appropriate, e.g. native species of local provenance. f) Timetable for implementation demonstrating that works are aligned with the proposed phasing of development. g) Persons responsible for implementing the works. h) Details of initial aftercare and long-term maintenance.
Reason: To enable proper consideration of the impact of the development on the contribution of nature conservation. (Section 15, NPPF) |

None of the dwellings hereby permitted shall be first occupied or brought into use until the details of any external lighting to be installed on the site, including the design of the lighting unit, any supporting structure and the extent of the area to be illuminated, have been submitted to and approved in writing by the Local Planning Authority. The external lighting shall be installed in accordance with the approved details and maintained thereafter. No other external lighting shall be installed outside the curtilage of individual dwellings without the written approval of the Local Planning Authority.
Reason: To ensure that the proposed parking court is adequately lighted to enhance safety and security whilst ensuring that the neighbouring occupiers at No. 11 Orchard Close are not subject to unacceptable levels of light pollution. (Policy DM3, CSDMP and Sections 8 and 12, NPPF) |

None of the dwellings hereby permitted shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the details approved pursuant to condition 4 of planning permission CB/18/04165/OUT.
Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the proposed estate road. (Section 9, NPPF) |

Visibility splays shall be provided at the highway/ private drives access within the site. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the side road from its junction with the channel to the through road and 25m measured from the centre line of the side road along the channel of the through road. The vision splays required shall be provided and defined on the site by or on behalf of the developers and be entirely free of any obstruction.
Reason: To provide adequate visibility at road junction in the interest of road safety (Section 9, NPPF) |

If the proposed road is not constructed to the full length and layout illustrated on the approved plan, a temporary turning space for vehicles shall be constructed within the site in a position to be approved in writing by the Local Planning Authority before any building taking access from the road is occupied.
Reason: To avoid the need for vehicles to reverse into or from the highway in the interest of road safety. (Section 9, NPPF) |

The development shall take place strictly in accordance with either a Construction Traffic Management Plan that has been approved pursuant to condition 9 of planning permission CB/18/04165/OUT or a separate Construction Traffic Management which is to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and shall contain the following information:
(A) The parking of vehicles (B) Loading and unloading of plant and materials used in the development (C) Storage of plant and materials used in the development (D) The erection and maintenance of security hoarding / scaffolding affecting the highway if required. (E) Wheel washing facilities (F) Measures on site to control the deposition of dirt / mud on surrounding roads during the development. (G) Footpath/footway/cycleway or road closures needed during the development period (H) Traffic management needed during the development period including tracking for those building materials and plant equipment brought in by HGV's. (I) Times, routes and means of access and egress for construction traffic and delivery vehicles (including the import of materials and the removal of waste from the site) during the development of the site.
Reason: To ensure the safe operation of the surrounding road network in the interests of road safety. (Section 9, NPPF) |

The planting and landscaping scheme shown on approved Drawing No. LC-2769-03 Rev A shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the management scheme set out on the approved Drawing, and any which die or are destroyed within 5 years of planting shall be replaced during the next planting season with others of a similar size and species.
Reason: To ensure an acceptable standard of landscaping. (Policy DM3, CSDMP and Sections 12 & 15, NPPF) |

For the avoidance of doubt, the height of the approved boundary treatment to be installed on the boundary of the site with No. 11 Orchard Close ( as shown on drawing no. 5248-TFP-ZZ-ZZ-DR-A-2060 Rev P05) shall be taken from the ground level of No. 11 Orchard Close. None of the dwellings hereby permitted shall be occupied until the boundary treatment between the site and No. 11 Orchard Close has been installed in accordance with the approved plan. The boundary treatment shall be maintained in accordance with the approved details thereafter.
Reason: To safeguard the privacy of occupiers of No. 11 Orchard Close. (Policy DM3, CSDMP and Section 12, NPPF) |

The first floor windows in the rear elevations of the dwellings on plots 46 and 47 of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows are installed. No further windows or other openings shall be formed in the rear elevation of those dwellings, other than at ground floor level, unless subsequently allowed by a planning application made for that purpose.
Reason: To safeguard the privacy of occupiers of No. 11 Orchard Close. (Policy DM3, CSDMP and Section 12, NPPF) |
11)
No development shall take place above slab level until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of fire hydrants at the development. Prior to the first occupation of the dwellings hereby approved the fire hydrant(s) serving the dwellings shall be installed as approved. Thereafter the fire hydrant(s) shall be retained as approved in perpetuity.
Reason: In the interests of fire safety and providing safe and accessible developments. (Section 8, NPPF) |

Before the development is brought into use, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout illustrated on the approved plan No. 5248-TFP-ZZ-SP-DR-A-2004 S1 Rev P19 and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.
Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times. (Section 9, NPPF) |

Notwithstanding the submitted details, any trees within the road hereby approved shall each be supported and protected by a treated timber tree stake to measure 75mm diameter x 1800mm-2100mm.
Reason: To safeguard the health of the proposed trees in the interests of securing a high quality development. (Policies CS14 & DM3, CSDMP and Section 12, NPPF). |

In the event that contamination is found at any time when carrying out the approved development, it shall be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment shall then be undertaken by a competent person, in accordance with 'Model Procedures for the Management of Land Contamination, CLR 11'. A written report of the findings should be forwarded for approval to the Local Planning Authority. Following completion of remedial measures a verification report shall be prepared that demonstrates the effectiveness of the remediation carried out. No part of the development should be occupied until all remedial and validation works have been approved in writing by the Local Planning Authority.
Reason: To ensure that no future investigation is required under Part 2A of the Environmental Protection Act 1990. (Section 15, NPPF) |
15)
None of the dwellings hereby permitted shall be occupied until foul and surface water drainage has been provided in accordance with the document Drainage Strategy by Gyoury Self Partnership (St Albans) LLP, dated 14 August 2020, reference no. 14842PL-DRN02 and drawing no. 14842PL 221 Rev P2 and the following information has been submitted to and approved in writing by the Local Planning Authority:
written confirmation that the approved surface water drainage scheme has been correctly and fully installed as per the approved details; and a finalised 'Maintenance and Management Plan' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities
The drainage system shall be maintained and managed in accordance with the approved Maintenance and Management Plan thereafter.
Reason: To minimise and manage flood risk and to ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161. (Section 14, NPPF) |
16)
None of the dwellings hereby permitted shall be first occupied until the following information has been submitted to and approved in writing by the Local Planning Authority:
Part G calculations showing that the higher water efficiency standard of 110 l/p/d is achieved in all dwellings; and either Part L compliance reports showing that DER is 10% lower than TER; or Evidence that 10% of the development's electricity requirements will be met by installed renewable energy.
Reason: In order to ensure the sustainability of the development and to minimise the development's impact on climate. (Policies CS13, DM1 and DM2, CSDMP and Section 14 NPPF). |
