Conditions or Reasons for Planning Application - CB/21/00051/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than one year from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the commencement of the development the junction of the proposed vehicular access with the highway serving the proposed consented installation for the gas fuelled generators, shall be constructed under a Section 278 Agreement in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
3) Visibility splays shall be provided at the junction of the access with the public highway before the development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m  measured along the centre line of the proposed access from its junction with the channel of the public highway and 85m in a south eastern direction and 66m in a north westerly direction measured either side from the centre line of the proposed access along the line of the channel of the public highway.  The required vision splays shall, on land in the applicant's control, be kept free of any obstruction, in excess of 0.6m above the adjoining carriageway level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it.
4) The proposed driveway access shall be constructed and surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 8m into the site, measured from the highway boundary, before the development is brought in to use.  Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway.
5) Any gates provided shall open away from the highway and be set back a distance of at least 12m from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened.
6) No development shall commence until details of a wheel wash facility to prevent and deal with site debris from being deposited on the public highway have been submitted to and approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway. The approved details shall be implemented throughout the construction works and until the completion of the development.

Reason: In the interests of highway safety and to prevent the deposit of mud or other extraneous material on the highway during the construction period.
7) The development shall not be brought into use until a turning space for service vehicles has been constructed within the curtilage of the site in a manner to be approved in writing by the Local Planning Authority.

Reason: To enable vehicles to draw off, park and turn outside of the highway limits thereby avoiding the reversing of vehicles on to the highway.
8) If a complaint concerning noise between the hours of 2300-0700hrs is received by the Council the following measures will be taken: within one month, the operator shall submit to the Local Planning Authority a report identifying the source(s) of noise and a scheme for controlling and/or mitigation of noise during the hours of 2300-0700.

Details of the scheme shall include the undertaking of further monitoring and, where appropriate, of additional noise control measures, along with an implementation scheme for any additional mitigation. All additional noise control measures shall be implemented in accordance with the approved details and retained in perpetuity.  Until the noise control measures are approved by the Local Planning Authority there shall be no more than 4 occurrences of operations for the generation of electricity between 2300-0700hrs

Reason: Reason: To safeguard the residential amenity of neighbouring properties.
(Section 7, NPPF)
