Conditions or Reasons:
3) No development shall take place until a Phase 1 Desk Study report adhering to BS 10175 documenting the ground and material conditions of the site with regard to potential contamination has been submitted to and approved in writing by the Local Planning Authority. No occupation of any permitted building shall take place until the following have been submitted to and approved in writing by the Local Planning Authority:

Where shown to be necessary by the Phase 1 Desk Study, a Phase 2 Site Investigation adhering to BS 10175 and incorporating all appropriate sampling.

Where shown to be necessary by the Phase 2 Site Investigation a detailed Phase 3 remediation scheme with measures to be taken to mitigate any risks to human health, groundwater and the wider environment. Any works which form part of the Phase 3 scheme approved by the local authority shall be completed in full before any permitted building is occupied.

The effectiveness of any scheme shall be demonstrated to the Local Planning Authority prior to occupation by means of a validation report (to incorporate photographs, material transport tickets and validation sampling), unless an alternative period is approved in writing by the Authority. Any such validation should include responses to any unexpected contamination discovered during works.

Reason: The condition must be discharged prior to commencement to ensure that the site is suitable for its end use and to protect human health and the environment.

4) No development shall take place until a comprehensive noise survey based on current surrounding uses has been submitted to the Local Planning Authority for consideration. If shown to be required, the survey shall be accompanied by a mitigation scheme designed to deal with the findings of the acoustic assessment, which may include the windows on all facades adversely affected by industrial or commercial noise to be fixed shut in perpetuity and a ventilation strategy to deal with both purge and trickle ventilation to meet the requirements of building regulations. Development shall not commence until the scheme has been approved in writing by the Local Planning Authority. The scheme shall thereafter be implemented in full and maintained as such thereafter.

Reason: The condition must be discharged prior to commencement to ensure the protection of future occupiers of the development from unacceptable levels of noise pollution and to prevent the adjoining industrial and commercial units from being detrimentally affected by the proposed development.

10) No development shall take place until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of a fire hydrant at the development. Prior to the first occupation of the dwellings the fire hydrant serving that development shall be installed as approved. Thereafter the fire hydrant shall be retained as approved in perpetuity.

Reason: In the interests of fire safety and providing safe and accessible developments.
