Conditions or Reasons for Planning Application - CB/21/00651/OUT
Conditions or Reasons:
1) Application for the approval of the reserved matters shall be made to the Local Planning Authority within three years from the date of this permission. The development shall begin not later than two years from the final approval of the reserved matters or, if approved on different dates, the final approval of the last such matter to be approved.

Reason: To comply with Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place within each area approved as identified on drawing no. A48208 04B until approval of the details of the appearance, landscaping and scale of the development [and any other details required i.e. the landscaping adjoining it] within that area (herein called 'the reserved matters') has been obtained in writing from the Local Planning Authority. The development shall be carried out in accordance with the approved details.

Reason: To comply with Part 3 Article 6 of the Town and Country Planning (General Development Procedure) Order 2015.
3) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers A 48208 01; A 48208 02A; A 48208 03; A 48208 04B; A 48208 05; and A 48208 06B

Reason: To identify the approved plan/s and to avoid doubt.
4) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
5) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
6) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building(s) hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building/s in the interests of the amenities of the area.

7) In the event that contamination is found at any time when carrying out the approved development, it shall be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment shall then be undertaken by a competent person, in accordance with 'Model Procedures for the Management of Land Contamination, CLR 11'. A written report of the findings should be forwarded for approval to the Local Planning Authority. Following completion of remedial measures a verification report shall be prepared that demonstrates the effectiveness of the remediation carried out. No part of the development should be occupied until all remedial and validation works are approved in writing.

Reason: To ensure that no future investigation is required under Part 2A of the Environmental Protection Act 1990
8) The reserved matters applications submitted in accordance with Condition 02 of this permission, shall include full details of the bin [storage/collection] areas. The bin storage/collection areas thereby approved shall be implemented in accordance with the approved details before any dwelling hereby permitted is occupied and shall be retained thereafter.

Reason: In the interest of amenity.

9) The reserved matters applications submitted in accordance with Condition 02 of this permission, shall include full details of the existing and final ground and slab levels of the buildings hereby approved. Such details shall include sections through both the site and the adjoining properties, the location of which shall first be agreed in writing with the Local Planning Authority. Thereafter the site shall be developed in full accordance with the approved details.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

10) The reserved matters applications submitted in accordance with Condition 02 of this permission, shall include full surfacing details of the proposed vehicular access, which shall be surfaced in a bituminous or other similar durable material as may be approved in writing by the Local Planning Authority for a distance of 5m into the site, measured from the highway boundary. Arrangements shall be made for the surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
11) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision inclusive of the visitor parking bay on the site shall not be used for any purpose, other than as parking provision, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users, in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
12) The proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, parking layout and provision, and the turning area illustrated on the approved drawing no. A 48208 06B and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times, in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
13) Before the development is bought into use the visibility splays as indicated on the approved drawing no. A 48208 06B in land under the applicants control shall be provided and thereafter be kept free of all obstruction to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it, in accordance with policy DM3 of the Core Strategy and Development Management Policies (2009).
14) The development hereby permitted shall not exceed more than two dwellings, without the prior written approval of the Local Planning Authority.

Reason: To ensure a satisfactory development and to avoid doubt.
