Conditions or Reasons for Planning Application - CB/21/00785/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The premises shall only be open to customers between the hours of 0700 to 2000 hours on any day and at no other time without the prior approval in writing of the Local Planning Authority.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

3) Unless otherwise agreed in writing by the Local Planning Authority, the individual and cumulative rating level of noise emitted from plant and/or fixed machinery at the development hereby approved shall be no greater than the existing background noise level. The noise levels shall be determined at the façade of the nearest residential property. The measurements and assessment shall be made in accordance with British Standard 4142;Method for rating industrial noise affecting mixed residential and industrial areas. Before any plant is used, measurements of the noise from the plant must be taken and a report / impact assessment demonstrating that the plant (as installed) meets the design requirements, shall be submitted to be approved in writing by the Local Planning Authority.

Reason: To ensure that the development achieves a high standard of amenity for the occupiers of adjacent buildings (Sections 12 and 15, NPPF 2019).
4) The first floor windows in the north-eastern, south-western and north-north-western elevations of the development serving bathroom, corridor and utility rooms hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through them at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows are installed. No further windows or other openings shall be formed in any first floor elevation.

Reason: To safeguard the privacy of occupiers of adjoining properties

5) The area shown on approved drawing ref: CBC04 as parking space for 2 cars on the north-eastern side of the building shall be retained for use by the first floor flat hereby approved and for no other use, unless otherwise agreed in writing by the Local Planning Authority.

Reason

To ensure an adequate level of parking for the approved residential accommodation (Section 12, NPPF, 2019)
6) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC01; CBC02; CBC03; CBC04

Reason: To identify the approved plan/s and to avoid doubt.
