Conditions or Reasons for Planning Application - CB/21/00786/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development shall not be brought into use until the junction/crossover of the proposed vehicular access with the highway has been re/constructed in accordance with the approved details.

Reason:
In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
3) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres from the nearside edge of the carriageway of the adjoining highway. The gates shall have unobstructed opening to all vehicles using the site and turning area

Reason:
To enable vehicles to draw off the highway before the gates are opened and for vehicles to utilise the turning area and not reverse into the highway
4) Prior to the commencement of the development, a detailed Phase 3 remediation scheme shall be submitted for approval in writing by the Local Planning Authority. This scheme shall detail measures to be taken to mitigate any risks to human health, groundwater and the wider environment. The remediation proposals shall be in accordance with the recommendations in the EPS Ltd Phase 2 Environmental Assessment dated 28th September 2018 (Ref: UK18.4141B). Any works which form part of the Phase 3 scheme approved by the local authority shall be completed in full before any permitted building is occupied.

Reason: To protect human health and the environment.
5) Details of a turning area suitable for a 6.5m length service/delivery/ambulance sized vehicle and a visitor parking space measuring 2.5m x 5.0m shall be submitted to and approved in writing by the local planning authority, and the development shall not be brought into use until the approved details have been implemented. Thereafter the turning area and visitor parking space shall be retained unless otherwise agreed in writing by the local planning authority

Reason:
To provide adequate visitor parking provision clear of the public highway and without obstruction to manoeuvring vehicles within the site, and to provide adequate on site turning facilities to alleviate vehicle reversing into the public highway and exceeding the reversing distance
6) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995, or any amendments thereto, the parking provision on the site shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason:
To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.
7) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
8) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 2034 100A, 2034 110, 2034 120A.

Reason: To identify the approved plan/s and to avoid doubt.
