Conditions or Reasons for Planning Application - CB/21/01347/RM
Conditions or Reasons:
1) No development above slab level for the dwelling hereby approved shall take place, notwithstanding the details submitted with the application, until details of the materials and goods to be used on the external walls and roofs of the development hereby approved have been submitted to the Local Planning Authority for its approval in writing. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

2) Prior to the commencement of above slab level works for the detached single garage building hereby approved, details of the goods and the materials to be used for the external walls and roofs of this building shall be submitted to the Local Planning Authority for its approval in writing. The detached single garage development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the detached garage building in the interests of the visual amenities of the locality.

3) The development hereby approved shall not be occupied until details of the widening and resurfacing of the junction of the vehicular access with the highway and the short pedestrian access link across the highway, have been submitted to the Local Planning Authority for its approval in writing. No building hereby approved shall be occupied until the access and pedestrian link have been resurfaced/ constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway andthe premises. (Section 9, NPPF)
4) Before the dwelling hereby approved is first occupied, a scheme shall be submitted to the Local Planning Authority for its approval in writing indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme before the approved dwelling is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) Prior to the first occupation of the dwelling hereby approved, a scheme for the provision of waste receptacles for ethe dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
6) The dwelling hereby permitted shall not be occupied until a scheme for the parking of cycles on the site has been submitted to the Local Planning Authority for its approval in writing. The scheme shall be fully implemented before the development is first occupied and thereafter retained for this purpose.

Reason: To ensure the provision of cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport. (Section 9, NPPF)
7) The dwelling hereby approved shall not be occupied until a scheme (based on current government policy/guidance at the time of submission) for the provision of an electric charging point is submitted to the Local Planning Authority for its approval in writing. The charging point shall be provided as approved prior to the occupation of the dwelling and be retained thereafter.

Reason: To ensure the development protects and exploits opportunities for the use of sustainable transport modes for the movement of people in accordance with section 4 of the National Planning Policy Framework.
8) The vehicular driveway access shall be constructed and surfaced in a stable and durable material in accordance with details to be approved in writing by the Local Planning Authority for a minimum distance of 5m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be madefor surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of the highway. (Section 9, NPPF)
9) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to safely draw off the highway before the gates are opened. (Section 9, NPPF)
10) Before the development is first occupied or brought into use, the parking scheme shown on plan no MORR/22103/3BED1B, including the widening of the parking space located at the front of the dwelling to 3m, shall be completed and thereafter retained for this purpose.

Reason: To ensure the provision of car parking clear of the highway. (Policy T10, SBLPR and section 9, NPPF)
11) The first floor window in the eastern elevation serving a staircase in the two storey detached dwelling hereby approved shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed. No further windows or other openings shall be formed in the eastern flank wall of the dwelling hereby permitted without obtaining further explicit consent from the Local Planning Authority.

Reason: To safeguard the privacy of occupiers of the adjoining property Kingsclere

12) The detached single garage building, as shown on drawing number MORR/22103/3BED1B, shall only be used for purposes incidental to the enjoyment of the host two storey detached dwelling hereby approved.

Reason: To prevent the introduction of an inappropriate use harmful to the residential character of the area.

13) The dwelling hereby approved shall not be occupied until details of the bin storage & collection areas have been submitted to by the Local Planning Authority for its approval in writing and the bin storage/collection areas have been implemented in accordance with the approved details. The bin storage & collection areas shall be retained thereafter.

Reason: In the interest of protecting local amenity and public safety on the local highway network. (Section 9 & 12, NPPF)
14) The existing large mature tree positioned to the front of the dwelling hereby approved along the southern boundary of the application site and the existing hedgerows located along the southern and western boundaries of the application site, as shown on the submitted plan with drawing reference MORR/22103/3BED1B, shall be retained thereafter unless otherwise agreed in writing with the Local Planning Authority. If the tree or hedgerows to be retained die or are destroyed then they shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping is retained within the application site to protect the visual amenity of the local area and to support biodiversity.

15) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
16) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
17) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
18) This approval relates only to the details shown on the submitted plan, number MORR/22103/3BED1B.

Reason: To identify the approved plan and to avoid doubt.
