Conditions or Reasons for Planning Application - CB/21/02938/VOC
Conditions or Reasons:
1) The materials to be used for the dwelling and the adjacent area shall accord with the details set out on the materials schedule unless otherwise agreed in writing by the Local Planning Authority.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building and the visual amenities of the locality.
2) Notwithstanding the provisions of Part 1, Class A, B or C of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions or roof extensions to the dwellings hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the buildings in the interests of the amenities of the area.
(Policies CS14 & DM3, CSDMP and Section 13, NPPF)
3) All tree protection fencing should be installed in strict accordance with the "Arboricultural Method Statement", which forms Section 7 of the "Tree Report, Arboricultural Impact Assessment" (Ref: CAT PDS 0178-10.7.2017), and Appendix C the "Tree Survey and Protection Plan" (Ref. TSP SBAH 01 Rev A) as approved by application CB/18/03829/Full. The tree protection fencing shall remain securely in position throughout the entire duration of development works.

REASON: To ensure the satisfactory protection of retained trees from development activity, by creating a Construction Exclusion Zone around the trees, so as to maintain their health, stability and amenity value.
4) Throughout development all working practices, as required in Section 6 "Arboricultural Impact Assessment", which includes the access facilitation pruning, the specific Building Construction Requirements and "No-Dig" Construction Works, shall be carried out in strict accordance with both the "Arboricultural Method Statement", which forms Section 7 of the "Tree Report, Arboricultural Impact Assessment" (Ref: CAT PDS 0178-10.7.2017) and the Appendix C "Tree Survey and Protection Plan" (Ref. TSP SBAH 01 Rev A). Documents as approved by CB/18/03829/Full.

REASON: To ensure that appropriate working practices are carried out in the interests of safeguarding trees from development work activity, by avoiding poor working practices that could damage the trees, or which impose unnecessary pruning works, so as required to maintain their health, stability and amenity value.
5) Notwithstanding the applicant's general duty to replace trees that have died within a Conservation Area, as required under Section 213 of the Town and Country Planning Act 1990, if any of the two Silver Birch trees, presently located at a distance of 2.7m and 3.4m from the said retaining wall, shall die within a period of 5 years from the granting of this Variation of Condition, each dead tree shall be replaced with a new Silver Birch that is of at least girth size 14 to 16cm (measured at 1m), and be supplied in a container size of between 45 to 100 litres. Once planted, the tree(s) shall be maintained until satisfactorily established, and shall be subject to the same replacement planting requirements if any of these replacements themselves should die.

REASON
To make provision to replace trees that have incurred root damage from the construction of the new retaining wall, and which may subsequently die from the effects of such root damage, and to compensate for any loss of these trees that would otherwise be to the detriment of the Aspley Heath Conservation Area and its visual amenity. (Section 15 and 16 NPPF).
6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans/details as following: 13-16-L1 1316-L10E; 1316-B4F; 1316-B1G; Materials Schedule.

Reason: To identify the approved plans and to avoid doubt.
