Conditions or Reasons for Planning Application - CB/21/03664/FULL
Conditions or Reasons:
1) The development by reason of its constrained layout, siting and design fails to provide satisfactory internal floor space or standard area(s) of external private amenity space to serve the dwellings. In addition, the development has failed to provide a satisfactory outlook to the bedrooms of the dwellings and the siting of the shower rooms window causes unacceptable and perceived loss of privacy to Plot 3. The proposed development therefore provides substandard accommodation and creates a poor living environment for future occupiers of the development. The development does not represent high quality design, adding to the overall quality to the area and materially diminishes the approved development under CB/18/01628/OUT and causes harm to the character and appearance of the area. The development therefore conflict with Policies H2 and HQ1 of the Central Bedfordshire Local Plan (2021), the National Planning Policy Framework (2021), the Nationally Described Space Standards (2015) and the Central Bedfordshire Design Guide.
2) Insufficient information has been submitted to demonstrate the development benefits/ or would benefit from appropriate surface water drainage arrangements, including maintenance and management arrangements for the system. Any off site surface water drainage infrastructure would require a completed legal agreement to secure maintenance and management arrangements for any off site elements, which has not been secured. As such the development is unacceptable in the context of surface water drainage, contrary to policy CC5 of the Central Bedfordshire Local Plan (2021).
3) In the absence of a completed legal agreement securing a scheme to secure the provision and retention of pedestrian visibility splays the development would cause an unacceptable impact on highway safety contrary to policy T2 of the Central Bedfordshire Local Plan (2021) and paragraph 111 of the National Planning Policy Framework (2021).
4) The development forms part of the wider development approved under CB/18/01628/OUT, increasing the development from 22 dwellings to 24 dwellings. In the absence of a completed legal agreement securing financial contributions to offset infrastructure impact, including community facilities and sport, the development would have an unmitigated and unacceptable impact on existing local infrastructure. The development would therefore not amount to sustainable development and would be contrary to policies HQ2 and HQ3 of the Central Bedfordshire Local Plan (2021) and the objectives of the National Planning Policy Framework (2021).
