Conditions or Reasons for Planning Application - CB/21/04870/FULL
Conditions or Reasons:
1) The proposed development is unacceptable as a matter of principle as it represents inappropriate development in the Green Belt, which is by definition harmful and would cause harm to its openness due to its massing, scale, siting and position. The proposal would present encroachment into the countryside in conflict with one of the five purposes of Green Belt. No material considerations have been identified that clearly outweigh the harm caused to the Green Belt and any other harm. Consequently Very Special Circumstances do not exist and the proposal is contrary to the aims and objectives of Policy SP4 of the Central Bedfordshire Local Plan 2015-2035 and Section 13 of the NPPF.
2) The siting, built form, scale and height of the proposed dwelling will result in a harmful urbanised appearance to the undeveloped application site as well as an inappropriate relationship in terms of removal of mature trees covered by Tree Protection Orders bounding the site to the southeast; to the detriment of the AONB, ancient woodland, existing ecology and biodiveristy such that the economic & environmental enhancement would be considered to provide limited public benefit that wuld not clearly outweigh the loss or deterioration of the existing habitat. The development is contrary to the aims and objectives of Sections 12 & 15 of the National Planning Policy Framework and Policies HQ1, EE2, EE3, EE4, EE5 & EE7 of the Central Bedfordshire Local Plan.
3) The proposal would increase vehicular usage of an access with the public highway, where the standard of visibility is below acceptable standards, across land not within the control of the applicant and would lead to conditions of danger and inconvenience to both users of the highway and users of the private road. The development is contrary to the aims and objectives of Sections 9 & 12 of the National Planning Policy Framework and Policies HQ1 & T2 of the Central Bedfordshire Local Plan.
4) The Council considers that the proposed development would, by reason of its proximity lying within a 12.6 kilometre linear distance of the Ashridge Commons and Woods Site of Special Scientific Interest within the Chiltern Beechwoods Special Area of Conservation, add to the recreational disturbance in this area, likely to harm the integrity of the conservation purposes of the Chiltern Beechwoods Special Area of Conservation. The proposal would be contrary to the Habitat Regulations and paragraphs 187 and 188 of the National Planning Policy Framework 2023 and Policy EE3 of the Central Bedfordshire Local Plan.
