Conditions or Reasons for Planning Application - CB/21/05143/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the first occupation of the development hereby approved, full details of the method of odour abatement and all odour abatement equipment to be used, including predicted noise levels of the equipment in operation, shall be submitted to and approved by the Local Planning Authority. The approved equipment shall be installed and in full working order to the satisfaction of the Local Planning Authority prior to the use hereby permitted commencing and shall be used in accordance with the manufacturers instructions in perpetuity.

Reason

In the interest of the residential amenities of adjoining occupiers (Section 15, NPPF)
3) Prior to first occupation of the development hereby approved, a further noise assessment shall be submitted for approval by the Local Panning Authority as recommended by the previously submitted Syntegra Consulting Ltd report (Ref: 22-9046) dated April 2022. The report shall determine noise levels for the installation in accordance with relevant guidance.

Reason

In the interests of the residential amenities of adjoining occupiers (Section 15, NPPF)
4) The premises shall only be open to customers between the hours of 8 am to 6 pm Mondays to Fridays, 8 am to 6 pm on Saturdays, and not at all on Sundays and Bank Holidays.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

5) No above-ground development shall commence until a construction methodology has been submitted to and approved in writing by the Local Authority. The construction methodology shall demonstrate consultation with the Asset Protection Project Manager at Network Rail. The development shall thereafter be carried out in accordance with the approved construction methodology unless otherwise agreed in writing by the Local Planning Authority.

Reason

In the interests of the protection of the railway line to the rear of the application site (Section 12, NPPF)
6) No above-ground development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

7) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
8) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
9) Notwithstanding the provisions of Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any order revoking and re-enacting that Order with or without modification), the first floor of the premises shall only be used as offices/ storage ancillary to the approved uses at the site.

Reason: To prevent the establishment of an independent office/ storage unit on the site.

10) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers LB-0285-PL0-1-B; Plant Noise Assessment (Syntegra Consulting, ref: 22-9046, April 2022); Kitchen Odour Assessment (Syntegra Consulting, ref: 22-9046, April 2022).

Reason: To identify the approved plan/s and to avoid doubt.
