Conditions or Reasons for Planning Application - CB/21/05148/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004
2) The development shall proceed in accordance with the Preliminary Ecological Appraisal dated February 2021.
Reason: To protect features of recognised nature conservation importance. (Section 15, NPPF)
3) The surface water drainage shall be constructed to manage surface water runoff from the development for up to and including 1 in 100 year event (+40%CC), via discharge to an existing watercourse. The final detailed design shall be based on the agreed FRA and DS (Ref: Abington, Rev A, 13/12/22) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval. The discharge rate from the development will be limited to 1l/s.
(The applicant should address the points 1 to 4 of informative no. 5 when submitting details to discharge the condition.)

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with CBC Local policy CC3 to CC5 and NPPF Paras 159 to 169 Inclusive of foot notes 54 to 56 and its supporting technical guidance.
4) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Environmental Code of Practice' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
5) Notwithstanding the details shown, development shall not begin until details of the improvements to the junction of the vehicular access with the highway have been submitted to and approved by the Local Planning Authority and no building shall be occupied until the junction has been constructed in accordance with the approved details.
Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Policies T2 & T3 of CBLP, Section 9 of NPPF)
6) Visibility splays shown on the approved drawing shall be provided at the junction of the access with the public highway before the development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43m measured either side from the centre line of the proposed access along the line of the channel of the public highway. The required visions plays shall for the perpetuity of the development remain free of any obstruction to visibility.
Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it. (Policies T2 & T3 of CBLP, Section 9 of NPPF)
7) The maximum gradient of the vehicular access shall be 10% (1 in 10).
Reason: In the interests of the safety of persons using the access and users of the highway(Policies T2 & T3 of CBLP, Section 9 of NPPF)
8) The turning space for light goods service vehicles illustrated on the approved plan no PL-01 rev B shall be constructed before the development is first brought into use and retained in perpetuity.
Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway (Policies T2 & T3 of CBLP, Section 9 of NPPF)
9) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
10) Prior to occupation, a scheme for the secure and covered parking of cycles on the site, calculated at one cycle parking space per bedroom, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.
Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport (Section 9, NPPF)
11) The proposed driveway shall be surfaced in accordance with details shown on the approved drawing for a minimum distance of 8m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.(Policies T2 & T3 of CBLP, Section 9 of NPPF)
12) Details of a refuse collection point located at the site frontage, not within the public highway or any visibility splays, shall be submitted to and approved by the Local Planning Authority prior to the occupation of any dwelling. The scheme shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.
Reason: In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises.(Policies T2 & T3 of CBLP, Section 9 of NPPF)
13) Before the development is first occupied or brought into use, the parking scheme shown on plan no PL-04 rev A shall be completed and thereafter retained for this purpose.
Reason: To ensure the provision of car parking clear of the highway.(Policies T2 & T3 of CBLP, Section 9 of NPPF)
14) The parking bay shown as visitor parking on plan PL-01 rev B shall be kept as unassigned parking and in an open condition, fully available for this purpose and no bollard, barrier or similar device or designation signs shall be erected thereon.
Reason: To ensure the permanent availability of car parking spaces for visitors.(Policies T2 & T3 of CBLP, Section 9 of NPPF)
15) Notwithstanding the details submitted with the application, a full selection of external material samples, including proposed replacement or supplementary timber cladding, face brick, rainwater goods, roof coverings including ridge elements, proposed to be used in respect of the development hereby approved shall be provided for consideration by, and the written approval of, the Local Planning Authority prior to the commencement of any work of construction onsite either by way of :-i) a full samples assemblage made available on site for Local Planning Authority inspection, with product types, including bricks, identified by product name and manufacturer) a full photographic materials schedule submission, with product types, including bricks, identified by product name and manufacturer, and proposed timber cladding shown in profile. The approved development shall be undertaken thereafter strictly in accordance with the approved details.
Reason: To ensure that the approved development is carried out in a manner that safeguards the historic fabric and traditional character of the historic, and listed, buildings to be retained in the approved development (Section 16, NPPF). This is pre-commencement to ensure that appropriate materials are used to safeguard the historic fabric and traditional character of the buildings.
16) Notwithstanding the details submitted with the application, all boundary fencing and associated gates to be installed as part of the development hereby approved shall be strictly appropriate to the historic character of the site, full details of which, including intended finishes, shall be submitted to and approved in writing by the Local Planning Authority prior to any installation onsite, and the approved development shall be undertaken thereafter strictly in accordance with the approved details
Reason: To ensure that the approved development is carried out in a manner that safeguards the historic character of the site and the character of the listed buildings which the site contains (Section 16, NPPF)
17) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:·A Phase 1 Desk Study report documenting the ground conditions of the site with regard to potential contamination;·A Phase 2 Site Investigation (where shown as necessary the Phase 1 Desk Study);·A Phase 3 Remediation Scheme (where shown as necessary by the Phase 2 Site Investigation) All such work shall be undertaken in accordance with BS:10175:2011 or other appropriate guidance issued by the regulatory authorities. The work shall be sufficient to ensure that measures will be taken to mitigate any risks to human health and the wider environment.

Reason: To protect human health and to ensure that no future investigation is required under Part 2A of the Environmental Protection Act 1990. This is a pre-commencement condition in order to protect human health prior to development and ensure any potential contamination is dealt with appropriately.
18) Prior to any permitted dwelling being occupied a validation report shall be submitted and approved in writing by the Local Planning Authority to demonstrate the effectiveness of any agreed Remediation Strategy. Any such validation shall include responses to any unexpected contamination discovered during works.
Reason: To protect human health and to ensure that no future investigation is required under Part2A of the Environmental Protection Act 1990.
19) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
20) Prior to the occupation of the dwelling hereby approved, details of an electric charging point within the site shall be submitted to and approved in writing by the local planning authority. The approved details shall be implemented, with the charging point available for use prior to occupation.

Reason: To ensure that adequate parking with facilities for the charging of electric vehicles are provided in accordance with Policy T5 Ultra Low Emission Vehicles; Policy T3 Parking; Policy T2 Highways Safety and Design and Policy CC1 Climate Change and Sustainability Paragraphs 110, of the National Planning Policy Framework.
21) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL-04 Rev A.

Reason: To identify the approved plans and to avoid doubt
