Conditions or Reasons for Planning Application - CB/22/00151/OUT
Conditions or Reasons:
1) The proposed development is of a siting, form and scale which is out of keeping with and detrimental to the character, appearance and grain of development in the surroundings. The proposed dwellings appear contrived in design and layout and fails to respond positively to the character of existing built form and does not provide appropriate outside amenity or living standards for future occupiers, nor does it provide sufficient privacy for neighbouring residents. The development is therefore not of a high-quality design and layout which is appropriate to its setting, contrary to policies HQ1, SP7 and HQ8 of the Central Bedfordshire Local Plan 2015-2035, Policies PD3 and PD4 of the Langford Neighbourhood Plan 2021 and the CBC Design Guide. The development is also contrary to the objectives of the National Planning Policy Framework (2021) which seeks to encourage high quality sustainable development and Policy CC1 of the Central Bedfordshire Local Plan 2015-2035 in that it fails to demonstrate how the proposal has been designed to take account of climate change and reduce carbon emissions. The proposal does not therefore represent a sustainable form of development having regard to the Environmental Objective.
2) The proposed development, if permitted, would result in the intensification of use of a substandard access which makes no provision for adequate driver/driver intervisibility and driver/pedestrian intervisibility and will lead to conditions of danger and inconvenience to users of the highway and the property. It would also result in the intensification of use of a substandard access which makes no provision for the two way flow of vehicle traffic and will lead to conditions of danger and inconvenience to users of the highway and the property. The proposed development would be contrary to Section 9 of the National Planning Policy Framework (2021), Policy T2 of the Central Bedfordshire Local Plan 2015-2035 and the Central Bedfordshire Design Guide.
3) No ecological information or appropriate surveys, mitigation and compensatory measures provided to satisfy licensing tests, has been provided with the application to demonstrate that the proposal will not have an impact on protected species such as bats and great crested newts. Accordingly, the proposal is contrary to Policy EE3 of the Central Bedfordshire Local Plan 2015-2035 and paragraph 180 of the National Planning Policy Framework 2021 which states that when determining planning decisions if significant harm to biodiversity resulting from a development cannot be avoided, adequately mitigated, or as a last resort, compensated for, then planning permission should be refused.
