Conditions or Reasons for Planning Application - CB/22/00329/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those in drawing numbers P-02-000 P2, P-02-001 P2, A-03-005, CBC-001.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match those in drawing numbers P-02-000 P2, P-02-001 P2, A-03-005, CBC-001 in the interests of the visual amenities of the locality.

3) The tree removal and access facilitation pruning relating to this development shall be confined to that specified in Sections 4.4 to 4.9 (inclusive) - 'Pruning to facilitate
development', and its related photographs, and also that shown on the 'Proposed Layout and Tree Removals' dated April 2020 (Drawing No. 140603-P-21 Rev C), of the supporting document 'Arboricultural Report' dated December 2021 (Document Ref. No. 140603-PD-21), as prepared by Tim Moya Associates.

REASON
To ensure that unnecessary and unjustified tree removal, or excessive tree pruning, is prevented and that only tree work deemed to be required to facilitate development is
implemented.
4) Prior to development, and following the permitted tree works, all tree protection fencing shall be installed and positioned in strict accordance with the 'Tree Protection Plan' dated May 2020 (Drawing No. 140603-P-22 Rev D), which includes the required methodology set out in the Arboricultural Method Statement, and the 'Protective Fencing Specification' as set out in Figure 2 of the Tree Protection Plan. The tree protection fencing shall then be kept securely in position throughout the entire course of development works, and only partly removed to allow the required access for the new piled driveway.

REASON
To ensure that a secure construction exclusion zone is maintained to protect the retained trees from all ancillary development activity surrounding the site.
5) The construction of the new piled driveway must be carried out in strict accordance with that specified in Section 4.10 and 4.11 'Construction Principles', Section 4.12 'Construction Operations' and positioned as shown on the 'Tree Protection Plan' dated May 2020 (Drawing No. 140603-P-22 Rev D) of the supporting document 'Arboricultural Report' dated December 2021 (Document Ref. No. 140603-PD-21) as prepared by Tim Moya Associates. This shall include the provision of all designated 'Arboricultural Inspections', where these are indicated in the sequence of operations, and implementing the necessary trunk protection and ground protection measures, as deemed to be required by the 'Tree Protection Plan' and the 'Arboricultural Inspections'.

REASON
To ensure that the working methodology required to implement the construction of the new piled driveway is in accordance with the construction operations set out under Sections 4.10, 4.11 and 4.12 of the 'Arboricultural Report' so as to prevent root damage to retained trees adjacent to the driveway, where this is encroaching into the designated Root Protection Area of such trees.
6) No development shall take place until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers P-02-000 P2, P-02-001 P2, A-03-005, CBC-001

Reason: To identify the approved plan/s and to avoid doubt.
